Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) said: Sayyiduna Umar (may Allah be pleased with him) stood on the pulpit and said: I adjure by Allah any man who heard the judgement of the Messenger of Allah (peace and blessings be upon him) concerning the unborn child. So Haml bin Malik bin al-Nabighah al-Hudhali stood up and said: O Commander of the Believers! I was between two co-wives, and one of them wounded or struck the other with a tent pole, killing her and killing what was in her womb. "The Prophet (peace and blessings be upon him) judged, concerning the unborn child, (compensation of) a male or female slave." So Sayyiduna Umar (may Allah be pleased with him) said: Allahu Akbar! Had we not heard this hadith, we would have judged otherwise.

Al-Hudhali (may Allah be pleased with him) narrates that he had a wife, and then he married another woman in addition to her. The two became jealous of each other, and the Hilali woman struck the Amiri woman with a pole of my tent, and she miscarried a dead child. The Messenger of Allah (peace and blessings be upon him) said to them: "Pay its blood money." Then the guardian of that (striking) woman came and said: Shall I pay blood money for one who neither ate, nor drank, nor cried out? The blood of such a one is simply let go. He ((peace and blessings be upon him)) said: "Is this the rhymed speech of the Bedouins? Yes, pay its blood money; for it a male or female slave is due."

Abu al-Malih al-Hudhali (may Allah have mercy on him) narrates from Haml bin al-Nabighah that he had two wives, a Lihyani woman and a Mu'awi woman from Banu Mu'awiyah bin Zayd. The two of them came together and became jealous of each other, so the Mu'awi woman picked up a stone and threw it at the Lihyani woman while she was pregnant and had reached full term, killing her, and she delivered a boy. Then Haml bin Malik said to Imran bin Uwaymir: Pay me the blood money for my wife. So the two of them took their case to the Messenger of Allah (peace and blessings be upon him), and he ((peace and blessings be upon him)) said: "The blood money is upon the agnatic relatives ('asabah), and for the miscarried child there is a ghurrah: a male or female slave."

Abu al-Malih bin Usamah (may Allah have mercy on him) narrates that Haml bin Malik bin al-Nabighah had two co-wives, Mulaykah and Umm Afif. One of them threw a stone at her companion, which struck her private part, and she delivered a dead foetus and died herself. The matter was brought to the Prophet (peace and blessings be upon him), and he ((peace and blessings be upon him)) placed her blood money upon the people of the woman who killed her, and set for her foetus a male or female slave, or twenty camels, or one hundred sheep. Her guardian said: By Allah, O Prophet of Allah, it neither ate, nor drank, nor cried out with a sound; the blood of such a one is simply let go. The Prophet (peace and blessings be upon him) said: "We have nothing to do with the rhymed speech of the Jahiliyyah."
