حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ، ثَنَا عَارِمٌ أَبُو النُّعْمَانِ، ح وَحَدَّثَنَا أَبُو مُسْلِمٍ الكَشِّيُّ، ثَنَا سُلَيْمَانُ بْنُ حَرْبٍِ، ح وَحَدَّثَنَا الْحُسَيْنُ بْنُ إِسْحَاقَ التُّسْتَرِيُّ، ثَنَا أَبُو الرَّبِيعِ الزَّهْرَانِيُّ، قَالُوا: ثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ أَيُّوبَ، عَنْ أَبِي قِلَابَةَ، عَنْ حَسَّانَ بْنِ بِلَالِ بْنِ يَزِيدَ بْنِ قَتَادَةَ، حَدَّثَ أَنَّ رَجُلًا مِنْ أَهْلِهِ مَاتَ وَهُو عَلَى غَيْرِ دِينِ الْإِسْلَامِ قَالَ: فَوَرِثَتْهُ أُخْتِي دُونِي وَكَانَتْ عَلَى دِينِهِ، ثُمَّ إِنَّ أَبِي أَسْلَمَ فَشَهِدَ مَعَ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ حُنَيْنًا فَمَاتَ فَأَحْرَزَتْ مِيرَاثَهُ وَكَانَ تَرَكَ غُلَامًا وَنَخْلًا، ثُمَّ إِنَّ أُخْتِي أَسْلَمَتْ فَخَاصَمَتْنِي فِي الْمِيرَاثِ إِلَى عُثْمَانَ فَحَدَّثَهُ عَبْدُ اللهِ بْنُ الْأَرْقَمِ أَنَّ عُمَرَ قَضَى أَنَّهُ مَنْ أَسْلَمَ عَلَى مِيرَاثٍ قَبْلَ أَنْ يُقْسَمَ فَلَهُ نَصِيبُهُ فَقَضَى بِهِِ عُثْمَانُ فَذَهَبَتْ بِذَلِكَ الْأُولَى وَشَارَكَتْنِي فِي هَذَا " وَاللَّفْظُ لِحَدِيثِ أَبِي الرَّبِيعِ الزَّهْرَانِيِّ
Hassan bin Bilal bin Yazid bin Qatadah narrates that a man from his family died while he was following a religion other than Islam. He said: His inheritance went to my sister instead of me, because she was of his religion. Then my father embraced Islam and took part in the Battle of Hunayn with the Messenger of Allah (peace and blessings be upon him), then he passed away, and I took possession of his inheritance. He had left a slave and some date palms. Then my sister (also) embraced Islam and disputed with me over the inheritance, taking the matter to Uthman (may Allah be pleased with him). Abdullah bin al-Arqam told him that Umar (may Allah be pleased with him) had ruled that whoever embraces Islam before an inheritance is divided receives his share. So Uthman (may Allah be pleased with him) ruled accordingly; thus she had taken the first inheritance, and she also became my partner in this (second inheritance).
