حَدَّثَنَا الْعَبَّاسُ بْنُ الْفَضْلِ الْأَسْفَاطِيُّ، وَمُعَاذُ بْنُ الْمُثَنَّى، وَمُحَمَّدُ بْنُ أَحْمَدَ بْنِ الْبَرَاءِ، قَالُوا: ثنا عَلِيُّ بْنُ الْمَدِينِيِّ، ثنا هِشَامُ بْنُ يُوسُفَ، ثنا الْقَاسِمُ بْنُ فَيَّاضٍ، عَنْ خَلَّادِ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، عَنِ ابْنِ عَبَّاسٍ قَالَ: بَيْنَا رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يَخْطُبُ النَّاسَ يَوْمَ الْجُمُعَةِ، أَتَاهُ رَجُلٌ فَخَطَا النَّاسَ حَتَّى قَرُبَ إِلَيْهِ فَقَالَ: يَا رَسُولَ اللهِ، أَقِمْ عَلَيَّ الْحَدَّ، فَقَالَ: «اجْلِسْ» ، فَجَلَسَ، ثُمَّ قَامَ الثَّانِيَةَ فَقَالَ: يَا رَسُولَ اللهِ، أَقِمْ عَلَيَّ الْحَدَّ، فَقَالَ: «اجْلِسْ» ، فَجَلَسَ، ثُمَّ قَامَ الثَّالِثَةَ فَقَالَ: يَا رَسُولَ اللهِ، أَقِمْ عَلَيَّ الْحَدَّ، قَالَ: «وَمَا حَدُّكَ؟» قَالَ: أَتَيْتُ امْرَأَةً حَرَامًا، فَقَالَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ لِرِجَالٍ مِنْ أَصْحَابِهِ، فِيهِمْ عَلِيٌّ، وَابْنُ عَبَّاسٍ، وَزَيْدُ بْنُ حَارِثَةَ، وَعُثْمَانُ بْنُ عَفَّانَ: «انْطَلِقُوا فَاجْلِدُوهُ مِائَةً» ، وَلَمْ يَكُنْ تَزَوَّجَ، فَقِيلَ: يَا رَسُولَ اللهِ، أَلَا نَجْلِدُ الَّتِي خَبَثَ بِهَا؟ فَقَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «ائْتُونِي بِهِ» ، فَلَمَّا أُتِيَ بِهِ قَالَ لَهُ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «مَنْ صَاحِبَتُكَ؟» قَالَ: فُلَانَةُ، فَأَرْسَلَ إِلَيْهَا النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَدَعَاهَا، فَسَأَلَهَا عَنْ ذَلِكَ، فَقَالَتْ: كَذَبَ، وَاللهِ مَا أَعْرِفُهُ، وَإِنِّي مِمَّا قَالَ لَبَرِيئَةٌ، اللهُ عَلَى مَا أَقُولُ مِنَ الشَّاهِدِينَ، فَقَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «مَنْ شَاهِدُكَ عَلَى أَنَّكَ أَخْبَثْتَ بِهَا؛ فَإِنَّهَا تُنْكِرُ أَنْ تَكُونَ أَخْبَثْتَ بِهَا، فَإِنْ كَانَ لَكَ شَاهِدٌ جَلَدْتُهَا، وَإِلَّا جَلَدْتُكَ حَدَّ الْفِرْيَةِ» ، فَقَالَ: يَا رَسُولَ اللهِ، مَا لِي شَاهِدٌ، فَأَمَرَ بِهِ فَجُلِدَ حَدَّ الْفِرْيَةِ ثَمَانِينَ
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrated: Once the Messenger of Allah (peace and blessings be upon him) was delivering the sermon to the people on Friday when a man came, stepped over the people until he came near him (peace and blessings be upon him), and said: "O Messenger of Allah, establish the prescribed punishment (hadd) upon me." He (peace and blessings be upon him) said: "Sit down." So he sat down. Then he stood up a second time and said: "O Messenger of Allah, establish the prescribed punishment upon me." He (peace and blessings be upon him) said: "Sit down." So he sat down. Then he stood up a third time and said: "O Messenger of Allah, establish the prescribed punishment upon me." He (peace and blessings be upon him) asked: "And what is your punishment?" He said: "I had an unlawful relation with a woman." So the Prophet (peace and blessings be upon him) said to some of his Companions, among whom were Ali, Ibn Abbas, Zayd bin Harithah and Uthman bin Affan (may Allah be pleased with them): "Go and give him one hundred lashes." And he was not married. Someone said: "O Messenger of Allah, shall we not also lash the woman with whom he committed this indecency?" The Messenger of Allah (peace and blessings be upon him) said: "Bring him to me." When he was brought, the Messenger of Allah (peace and blessings be upon him) asked him: "Who is your partner?" He said: "So-and-so." So the Prophet (peace and blessings be upon him) sent for the woman, summoned her and asked her about it, and she said: "He has lied. By Allah, I do not even know him, and I am innocent of what he said; Allah is witness to what I am saying." So the Messenger of Allah (peace and blessings be upon him) said: "Who is your witness that you committed indecency with her? For she denies it. If you have a witness, I will lash her; otherwise I will give you the prescribed punishment for false accusation." He said: "O Messenger of Allah, I have no witness." So he (peace and blessings be upon him) gave the order, and he was given eighty lashes as the prescribed punishment for false accusation.
