It is narrated from Sayyiduna Rifa'ah bin Rafi' (may Allah be pleased with him) that Sayyiduna Umar al-Faruq (may Allah be pleased with him) asked him: Did you really do that, that when one of you had intercourse with his wife and then did not ejaculate, he would not take a bath? He said: "We used to do just that in the blessed time of the Messenger of Allah (peace and blessings be upon him); no prohibition concerning it came from Allah Almighty, nor did the Messenger of Allah (peace and blessings be upon him) forbid it."
Imam Ahmad narrated that Sayyiduna Rifa'ah bin Rafi' (may Allah be pleased with him) (who took part in the Pledge of Aqabah and the Battle of Badr) relates: I was with Sayyiduna Umar (may Allah be pleased with him) when it was said to him: Sayyiduna Zayd bin Thabit (may Allah be pleased with him) is giving people fatwas in the mosque about a man who has intercourse but does not ejaculate! Sayyiduna Umar (may Allah be pleased with him) ordered: Bring him to me at once. So he was brought. He said: "O enemy of yourself! Have you become so bold as to give people fatwas by your own opinion in the mosque of the Messenger of Allah (peace and blessings be upon him)?" He said: "I did not do so on my own; rather my paternal uncles told me this from the Messenger of Allah (peace and blessings be upon him)." He asked: "Which uncles?" He said: "Sayyiduna Ubayy bin Ka'b, Sayyiduna Abu Ayyub and Sayyiduna Rifa'ah bin Rafi' (may Allah be pleased with them)."
Sayyiduna Rifa'ah says: Then Sayyiduna Umar (may Allah be pleased with him) turned to me and asked: "What is this young man saying?" I said: "We used to do just that in the time of the Messenger of Allah (peace and blessings be upon him)." He asked: "Did you also ask the Messenger of Allah (peace and blessings be upon him) about it?" I said: "We used to do it this way in the time of the Messenger of Allah (peace and blessings be upon him)."
The narrator says: Then Sayyiduna Umar (may Allah be pleased with him) gathered the people, and they all agreed that "water (that is, ghusl) is obligatory only because of water (that is, ejaculation)", except for two men, namely Sayyiduna Ali bin Abi Talib and Sayyiduna Mu'adh bin Jabal (may Allah be pleased with them both); they both said: "When the circumcised part passes beyond the circumcised part, ghusl becomes obligatory."
Sayyiduna Ali (may Allah be pleased with him) said: "O Commander of the Believers! The most knowledgeable of people in this matter are the pure wives of the Prophet (peace and blessings be upon him)." So he sent a message to Sayyidah Hafsah (may Allah be pleased with her), and she said: "I have no knowledge about this." Then he sent a message to Sayyidah Aishah (may Allah be pleased with her), and she said: "When the circumcised part passes beyond the circumcised part, ghusl becomes obligatory."
Hearing this, Sayyiduna Umar (may Allah be pleased with him) became intensely angry and said: "Now if I come to know that anyone has had intercourse and not taken a bath, I will give him an exemplary punishment."
Abdullah bin Ahmad also mentioned this narration in detail, and Imam Ibn Ma'in declared the narrator named Ma'mar trustworthy.
The basis of this narration is in the two Sahihs, but in a context other than this one, and some have also narrated the hadith of Sayyidah Aishah (may Allah be pleased with her) separately.
Ahmad bin Mani' also narrated that Sayyiduna Zayd bin Thabit (may Allah be pleased with him) used to relate: "When a man has intercourse with a woman and does not ejaculate, ghusl is not obligatory upon him." When a man heard this, he went to Sayyiduna Umar (may Allah be pleased with him) and informed him. He said to him: "Go and bring him to me, so that you may be a witness against him." When he came, Sayyiduna Umar (may Allah be pleased with him) said: "O enemy of Allah! Are you misleading people without knowledge?" Sayyiduna Zayd (may Allah be pleased with him) said: "O Commander of the Believers! By Allah, I did not invent this on my own; rather my paternal uncles informed me of it." He asked: "Which of your uncles?" He said: "Ubayy bin Ka'b and Abu Ayyub (may Allah be pleased with them both)." At that time Rifa'ah bin Rafi' (may Allah be pleased with him) was also present with Sayyiduna Umar (may Allah be pleased with him), and he said: "O Commander of the Believers! We used to do just that in the time of the Messenger of Allah (peace and blessings be upon him)." He asked: "Did the Messenger of Allah (peace and blessings be upon him) know of it?" He said: "I have no knowledge of that."
Then Sayyiduna Ali (may Allah be pleased with him) said: "O Commander of the Believers! This is not right," and Sayyiduna Mu'adh (may Allah be pleased with him) also said the same: "O Commander of the Believers! This is not right."
