بَابٌ فِيمَنْ غَلَبَ الْعَدُوُّ عَلَى مَالِهِ ثُمَّ وَجَدَهُ .

عَنِ ابْنِ عُمَرَ ، عَنِ النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَالَ : " مَنْ أَدْرَكَ مَالَهُ فِي الْفَيْءِ قَبْلَ أَنْ يُقْسَمَ ، فَهُوَ أَحَقُّ بِهِ ، وَمَنْ أَدْرَكَهُ بَعْدَ أَنْ يُقْسَمَ، فَلَيْسَ لَهُ شَيْءٌ " .
رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ ، وَفِيهِ يَاسِينُ الزَّيَّاتِ وَهُوَ ضَعِيفٌ . وَقَدْ تَقَدَّمَتْ أَحَادِيثُ نَحْوَ هَذَا فِي الْأَحْكَامِ .
رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ ، وَفِيهِ يَاسِينُ الزَّيَّاتِ وَهُوَ ضَعِيفٌ . وَقَدْ تَقَدَّمَتْ أَحَادِيثُ نَحْوَ هَذَا فِي الْأَحْكَامِ .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) reports that the Prophet (peace and blessings be upon him) said: "Whoever finds his own property among the spoils before it is distributed has the greater right to it, and whoever finds it after it has been distributed will get nothing."
This narration has been recorded by Imam al-Tabarani in al-Mu'jam al-Awsat. Its chain contains a narrator, Yasin al-Zayyat, and he is da'if (weak). Some hadiths of this kind have already passed in the chapter on rulings.
