بَابٌ فِيمَنْ أَعْتَقَ مَا لَا يَمْلِكُ .
One who frees what he does not own

عَنِ ابْنِ عَبَّاسٍ عَنْ رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَالَ : " لَا طَلَاقَ إِلَّا مِنْ بَعْدِ عَقْدٍ ، وَلَا عِتْقَ إِلَّا مِنْ بَعْدِ مِلْكٍ " .
رَوَاهُ الطَّبَرَانِيُّ ، وَفِيهِ ابْنُ لَهِيعَةَ ، وَحَدِيثُهُ حَسَنٌ ، وَبَقِيَّةُ رِجَالِهِ رِجَالُ الصَّحِيحِ .

Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) relates this saying of the Prophet (peace and blessings be upon him): "Divorce can only be given after a contract (that is, marriage), and freeing a slave can only take place after ownership."
Imam al-Tabarani recorded this narration; its chain contains a narrator, Ibn Lahi'ah, and the hadith he narrates is hasan (good); the remaining narrators of this narration are the narrators of the Sahih.
