Majma al-Zawaid — Hadith 10794

عَنْ عَائِذِ بْنِ سَعِيدٍ قَالَ : قَالَ سَمِيرُ بْنُ زُهَيْرٍ الْجِسْرِيُّ : يَا رَسُولَ اللَّهِ ، إِنَّ أَخِي سَلَمَةَ بْنَ زُهَيْرٍ خَرَجَ يُهَاجِرُ إِلَى اللَّهِ وَرَسُولِهِ ، فَلَقِيَهُ رِعَاءُ رِكَابِكَ مِنْ بَنِي غِفَارٍ فَقَتَلُوهُ فِي الشَّهْرِ الْحَرَامِ ، وَقَدْ كَانَ بَيْنَنَا وَبَيْنَهُمْ دَمٌ فِي الْجَاهِلِيَّةِ .
فَدَعَاهُمْ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَسَأَلَهُمْ عَنْ ذَلِكَ ، فَقَالُوا : وَجَدْنَاهُ يَسُوقُ رِكَابَكَ ، فَأَرَدْنَا أَخْذَهُ فَامْتَنَعَ مِنَّا ، فَقَتَلْنَاهُ ، فَلَا أَدْرِي : هَلْ حَلَّفَهُمْ أَوْ صَدَّقَهُمْ ؟ .
غَيْرَ أَنَّهُ قَدْ سَأَلَهُ عَنْ إِسْلَامِ أَخِيهِ فَلَمْ يَجِدْ بَيِّنَةً ، فَعَقَلَ لَهُ حُرْمَةَ الشَّهْرِ خَمْسِينَ مِنَ الْإِبِلِ . قَالَ : فَبَقِيَّةُ الْإِبِلِ فِي بَيْتِهِ أَفْضَلُ نَعَمٍ وَأَعْظَمُهُ بَرَكَةً . رَوَاهُ الطَّبَرَانِيُّ ، وَفِيهِ يَعْقُوبُ بْنُ مُحَمَّدٍ الزُّهْرِيُّ ، وَهُوَ مَتْرُوكٌ .
A'idh bin Sa'id narrates: Sayyiduna Sumayr bin Zuhayr al-Jisri (may Allah be pleased with him) said: "O Messenger of Allah, my brother Salamah bin Zuhayr set out to emigrate to Allah and His Messenger. The herdsmen of your riding camels, from Banu Ghifar, met him and killed him in the sacred month, because there had been a blood feud between us and them since the Age of Ignorance." The Prophet (peace and blessings be upon him) summoned those people and asked them about it. They said: "We found this man driving away your riding camels. We tried to seize him, but he would not submit to us, so we killed him." The narrator said: I do not know whether the Prophet (peace and blessings be upon him) made them swear an oath or simply accepted their word as true. However, the Prophet (peace and blessings be upon him) asked that man about his brother's Islam, and no proof of it was found, so the Prophet (peace and blessings be upon him), on account of the sanctity of the sacred month, gave them fifty camels as blood money. The narrator said: Those camels were superior to all the other camels in his house and more abundant in blessing.
Al-Tabarani recorded it. Its chain contains a narrator, Ya'qub bin Muhammad al-Zuhri, who is matruk (abandoned).
