Majma al-Zawaid — Hadith 10659

وَعَنْ أَبِي مَاجِدٍ الْحَنَفِيِّ قَالَ : جَاءَ رَجُلٌ بِابْنِ أَخٍ لَهُ إِلَى عَبْدِ اللَّهِ سَكْرَانَ ، فَقَالَ : إِنِّي وَجَدْتُ هَذَا سَكْرَانَ ، فَقَالَ عَبْدُ اللَّهِ : تَرْتِرُوهُ مَزْمِزُوهُ وَاسْتَنْكِهُوهُ . قَالَ : فَتَرْتَرُوهُ وَمَزْمَزُوهُ وَاسْتَنْكَهُوهُ ، فَوُجِدَ مِنْهُ رِيحُ الشَّرَابِ ، فَأَمَرَ بِهِ عَبْدُ اللَّهِ إِلَى السِّجْنِ ثُمَّ أَخْرَجَهُ مِنَ الْغَدِ ، ثُمَّ أَمَرَ بِسَوْطٍ فَدُقَّتْ ثَمَرَتُهُ حَتَّى أَحْنَتْ لَهُ مُخْفَقَةً ثُمَّ قَالَ لِلْجَلَّادِ : اجْلِدْهُ وَأَرْجِعْ يَدَكَ وَأَعْطِ كُلَّ عُضْوٍ حَقَّهُ .
فَضَرَبَهُ ضَرْبًا غَيْرَ مُبَرِّحٍ أَوْجَعَهُ ، وَجَعَلَهُ فِي قَبَاءٍ وَسَرَاوِيلَ أَوْ قَمِيصٍ وَسَرَاوِيلَ ، ثُمَّ قَالَ : بِئْسَ وَاللَّهِ وَالِي الْيَتِيمِ ، مَا أَدَّبْتَ فَأَحْسَنْتَ الْأَدَبَ ، وَلَا سَتَرْتَ الْخِزْيَةَ ، فَقَالَ : يَا أَبَا عَبْدِ الرَّحْمَنِ ، إِنَّهُ ابْنُ أَخِي أَجِدُ لَهُ مِنَ اللَّوْعَةِ مَا أَجِدُ لِوَلَدِي ! ! فَقَالَ عَبْدُ اللَّهِ : إِنَّ اللَّهَ جَلَّ وَعَزَّ يُحِبُّ الْعَفْوَ ، وَلَا يَنْبَغِي لِوَالٍ أَنْ يُؤْتَى بِحَدٍّ إِلَّا أَقَامَهُ .
ثُمَّ أَنْشَأَ يُحَدِّثُ عَنْ رَسُولِ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَالَ : إِنَّ أَوَّلَ رَجُلٍ مِنَ الْمُسْلِمِينَ قُطِعَ مِنَ الْأَنْصَارِ - أَوْ : فِي الْأَنْصَارِ - فَقِيلَ : يَا رَسُولَ اللَّهِ ، هَذَا سَرَقَ . - فَذَكَرَ نَحْوَ مَا تَقَدَّمَ . وَأَبُو مَاجِدٍ ضَعِيفٌ .
Abu Majid al-Hanafi narrates: A man came to Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) bringing his nephew, who was intoxicated. The man said: "I found him intoxicated." Sayyiduna Abdullah (may Allah be pleased with him) said: "Shake him so that he comes to his senses." The narrator says: The people shook him and moved him about, and the smell of wine was coming from his mouth. Sayyiduna Abdullah (may Allah be pleased with him) ordered that he be imprisoned; then the next day he was taken out. Then Sayyiduna Abdullah (may Allah be pleased with him) ordered a whip to be prepared; its tip was removed until it became light. Then Sayyiduna Abdullah (may Allah be pleased with him) said to the flogger: "Flog him, keep your hand held back, and give every limb its due." So the flogger struck him in a way that was not severe, yet was painful. Sayyiduna Abdullah (may Allah be pleased with him) had kept him clothed in a cloak (qaba') and trousers, or a shirt and trousers. Then Sayyiduna Abdullah (may Allah be pleased with him) said (to his uncle): "By Allah! You are a bad guardian of an orphan. You neither raised him with good upbringing, nor did you conceal this disgraceful matter." He said: "O Abu Abd al-Rahman, he is my nephew; I feel for him the same love that I feel for my own children." Sayyiduna Abdullah (may Allah be pleased with him) said: "Indeed, Allah Almighty loves pardon, but it is not proper for a ruler that a case of a prescribed punishment comes to him and he does not carry it out." Then Sayyiduna Abdullah (may Allah be pleased with him) related from the Prophet (peace and blessings be upon him); he said: "The first man among the Muslims whose hand was cut off was from the Ansar. It was said: 'O Messenger of Allah! This man has stolen.'" After that is the hadith as before, which has already passed. The narrator Abu Majid is da'if (weak).
