Al-Muntaqa Ibn al-Jarud 970 — What is reported about emancipation
حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى ، قَالَ : ثنا حَمَّادُ بْنُ مَسْعَدَةَ ، عَنْ مَالِكٍ ، عَنْ نَافِعِ ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " أَيُّمَا عَبْدٍ كَانَ بَيْنَ شُرَكَاءَ فَأَعْتَقَ أَحَدُهُمْ نَصِيبَهُ ، فَعَلَيْهِ أَنْ يُعْتِقَ مَا بَقِيَ مِنْهُ إِذَا كَانَ لَهُ مِنَ الْمَالِ مَا يَبْلُغُ ذَلِكَ ، وَإِلا عَتَقَ مِنْهُ مَا عَتَقَ " .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates that the Prophet Muhammad (peace and blessings be upon him) said: If a slave is owned by several partners, and one of them frees his share, then if he has wealth equal to the (remaining) value of the slave, it is his responsibility to free the remaining share as well. Otherwise (if he does not have wealth), then only the portion that has been freed on his behalf will be considered freed.
