بَابُ الْقَضَاءِ بِالْقُرْعَةِ فِيمَا إِذَا إِذْهَا الْخَصْمَانِ مِلْكَ شَيْءٍ وَلَمْ يَكُن لَهُمَا بَينَةٌ وَمَا ذَا يَفْعَلُ إِذَا كَانَ لَهُمَا بينةٌ وَتَعَارَضَتِ البَيِّنَاتُ
Chapter: Judging by drawing lots when two litigants claim ownership and have no evidence, and what to do if both have evidence and the evidences conflict

عَنْ أَبِي بُرْدَةَ عَنْ أَبِيهِ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَآلِهِ وَسَلَّمَ فِي دَابَّةٍ لَيْسَ لِوَاحِدٍ مِنْهُمَا بَيِّنَةٌ فَجَعَلَهَا بَيْنَهُمَا نِصْفَيْنِ
It is narrated from Sayyiduna Abu Musa Ash'ari (may Allah be pleased with him) that two men brought a dispute over a beast of burden to the Messenger of Allah (peace and blessings be upon him), while neither of them had any evidence. So the Prophet (peace and blessings be upon him) divided the animal equally between them.
