❖ Question

If a widow, in the presence of her father, marries a man without his permission — is such a marriage valid according to the teachings of Islam or not?

❖ Answer

Al-ḥamdu lillāh, waṣ-ṣalātu wa-s-salāmu ʿalā Rasūlillāh, Ammā baʿd!

According to the teachings of Islam, whether a woman is a virgin or a widow (thayyib), her marriage is not valid without the permission and consent of her guardian (wali).

✦ Key Ruling:

◈ The permission of a wali is an essential condition for the validity of a marriage.
◈ This rule applies to all women, regardless of whether they are marrying for the first time or have previously been married.
