❖ Question:

Under what circumstances is a husband permitted to divorce his wife in Islam?
Additionally, can a man divorce a woman who claims to be Muslim but persists in acts of shirk (polytheism)?

❖ Answer:

◈ Islam Encourages Reconciliation Before Divorce

Islam teaches that a husband should exhaust all efforts to maintain the marriage before considering divorce.
Allah ﷻ says:

“As for those women from whom you fear arrogance (nushūz), then advise them, forsake them in bed, and [lastly] strike them. But if they obey you, then do not seek a way against them. Surely, Allah is Most High, Most Great.
And if you fear a split between the two, appoint an arbitrator from his family and one from hers. If they both desire reconciliation, Allah will bring about harmony between them. Indeed, Allah is All-Knowing, All-Aware.”

📖 Surah an-Nisāʾ: 34–35

This passage outlines a step-by-step process for resolving marital discord:

① Admonish her with advice
② Separate from her in the bed
③ Use light disciplinary measures
④ If conflict remains, involve arbitrators from both families

If all efforts fail, divorce becomes permissible.

❖ Divorce Is Allowed, But Regulated

Islam does not forbid divorce, but discourages it as a last resort.
The rulings of ṭalāq are detailed in Surah al-Baqarah, where Allah commands fairness, justice, and kindness during the process.

❖ Marrying a Polytheist (Mushrikah) Woman

A Muslim man cannot marry a mushrikah woman (polytheist or idolater).
Allah ﷻ clearly states:

“Do not marry polytheist women until they believe.”
📖 Surah al-Baqarah: 221

Such a marriage is invalid and impermissible.

❖ Exception: Marriage to a Kitābiyyah (Jewish or Christian Woman)

If a woman claims to follow a revealed scripture (i.e., the Torah or the Gospel), even if she commits acts of shirk, Islam permits marrying her, with conditions:

“…And [lawful for you are] the chaste women from those who were given the Scripture before you…”
📖 Surah al-Māʾidah: 5

Conditions include:

✔ She must be chaste (muḥṣanah)
✔ She must not have secret illicit relationships
✔ There must be no fear of harm to one’s own faith

✅ Conclusion:

➤ A husband is permitted to divorce his wife if all reconciliation efforts fail, but he should strive to resolve the matter peacefully first.

➤ Marrying a mushrikah woman is not allowed unless she embraces true Islamic faith.

➤ A scripture-following woman (Jew or Christian) may be married if she is chaste, faithful, and there is no threat to the Muslim man’s beliefs.
