Narrated from Sayyiduna Zaid bin Khalid Al-Juhani (may Allah be pleased with him) and Abu Hurairah (may Allah be pleased with him) that we were with the Messenger of Allah (ﷺ), when a man stood up and said, "O Messenger of Allah (ﷺ), judge between us according to the Book of Allah." Then the opposing party, who was more understanding, said, "O Messenger of Allah (ﷺ), he has spoken the truth, judge between us according to the Book of Allah, and allow me to speak." The Prophet (ﷺ) said, "Speak." He said, "My son was working as a laborer for this man, and he committed adultery with his wife. In compensation, I gave one hundred sheep and a slave. Then I asked the people of knowledge about the matter, and they informed me that my son should receive one hundred lashes and be exiled for a year, and his wife should be stoned." So the Prophet (ﷺ) said, "By Him in Whose hand is my soul, I will judge between you according to the Book of Allah. The one hundred sheep and the slave will be returned to you, your son will receive one hundred lashes and be exiled for a year." Then the Messenger of Allah (ﷺ) said, "Anis! (may Allah be pleased with him), who was from Banu Aslam, go to the woman, and if she confesses to the crime, then stone her." Sayyiduna Anis (may Allah be pleased with him) went, and the woman confessed to the crime, so he stoned her. Sufyan (may Allah have mercy on him) says, "'Aseef' means laborer."

It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with him) that the Jews came to the Messenger of Allah ﷺ and presented their case, saying that a man and a woman among them had committed adultery. The Messenger of Allah ﷺ said: "What ruling do you find in the Torah regarding stoning?" They replied, "We disgrace them and flog them." Sayyiduna Abdullah bin Salam (may Allah be pleased with him) said: "You are lying; the command of stoning is also in the Torah." Then they brought the Torah, opened it, and sat down. A Jew placed his hand over the verse of stoning and read what came before and after it. Abdullah bin Salam (may Allah be pleased with him) said to him: "Lift your hand." When he lifted his hand, the verse of stoning was underneath. They said, "Abdullah bin Salam (may Allah be pleased with him) has spoken the truth. O Muhammad ﷺ, there is a verse of stoning in it." So the Messenger of Allah ﷺ had both of them stoned. Abdullah bin Umar (may Allah be pleased with him) said: "I saw the man leaning over the woman, shielding her from the stones."
It is narrated from Sayyiduna Abu Hurairah (may Allah be pleased with him) and Sayyiduna Zayd bin Khalid Al-Juhani (may Allah be pleased with him) that two men presented their case before the Messenger of Allah ﷺ. One said, "Decide between us according to the Book of Allah," and the other, who was more understanding, said, "Yes, O Messenger of Allah ﷺ, decide between us according to the Book of Allah, and allow me to speak." He said, "My son was working as a laborer for this man, and he committed adultery with his wife. I was informed that my son was to be stoned, so I gave one hundred sheep and a slave girl as compensation. Then I asked the people of knowledge about the matter, and they told me that my son is to be punished with one hundred lashes and one year of exile, while stoning is for his wife." The Messenger of Allah ﷺ said, "By Him in Whose hand is my soul, I will certainly judge between you according to the law of Allah. The sheep and the slave girl are to be returned to you, and your son is to be punished with one hundred lashes and one year of exile." And he ﷺ ordered Anis Al-Aslami (may Allah be pleased with him) to go to the man's wife, and if she confessed to the crime, then to stone her. The woman confessed, so she was stoned. Imam Malik (may Allah have mercy on him) said: "'Al-Aseef' means a laborer."

It is narrated from Sayyiduna Abu Hurairah (may Allah be pleased with him) that Sayyiduna Sa’d bin ‘Ubadah (may Allah be pleased with him) asked the Messenger of Allah (peace and blessings be upon him): “What do you think, if I see a man committing adultery with my wife, should I leave him and go bring four witnesses?” The Messenger of Allah (peace and blessings be upon him) said: “Yes.”
Sayyiduna Zaid bin Khalid al-Juhani (may Allah be pleased with him) and Sayyiduna Abu Hurairah (may Allah be pleased with him) said: We were sitting with the Messenger of Allah (peace and blessings be upon him) when a man came to him and said, "My slave girl has committed adultery." The Messenger of Allah (peace and blessings be upon him) said: "Flog her. If she commits adultery again, then flog her. If she commits adultery a third time, then flog her. If she commits adultery again, then sell her, even if only for the price of a rope."

It is narrated from Sayyiduna Abu Hurairah (may Allah be pleased with him) and Zaid bin Khalid (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) was asked about a slave girl: What is the ruling if an unmarried one commits fornication? He (peace and blessings be upon him) said: "If she commits fornication, flog her. If she commits fornication again, flog her. Then if she commits fornication again, flog her again. Then sell her, even if it is for a rope." Ibn Shihab (may Allah have mercy on him) says: I do not know whether he (peace and blessings be upon him) ordered her to be sold for a rope after the third or fourth time she committed fornication, and «ضَفِير» means a rope.

It is narrated from Sayyiduna Abdullah bin Safwan (may Allah be pleased with him) that it was said to Safwan bin Umayyah (may Allah be pleased with him): Whoever did not migrate has perished. So Safwan (may Allah be pleased with him) came to Madinah and stayed in the mosque, using his cloak as a pillow. A thief came and stole the cloak, so Safwan (may Allah be pleased with him) caught the thief and brought him to the Messenger of Allah (ﷺ). The Messenger of Allah (ﷺ) ordered that his hand be cut off. Safwan (may Allah be pleased with him) said: "O Messenger of Allah! I did not intend for his hand to be cut off; this cloak is charity for him." The Messenger of Allah (ﷺ) said: "Why did you not do this before bringing the thief to me?"

It is narrated from Muhammad bin Yahya bin Haban (may Allah have mercy on him): A slave stole a date palm sapling and planted it in his master's garden. The owner of the sapling came searching for it and found it there. The case of the slave was presented in the court of Marwan bin Hakam (may Allah have mercy on him). Marwan (may Allah have mercy on him) imprisoned the slave and intended to cut off his hand. Then the owner of the slave went to ask Rafi' bin Khadij (may Allah be pleased with him) about the matter. Rafi' (may Allah be pleased with him) informed him that he had heard the Messenger of Allah (ﷺ) say: "The hand is not to be cut off for stealing fruit or the pulp of dates." The man said that Marwan bin Hakam (may Allah have mercy on him) had detained his slave and wanted to cut off his hand, and he wished that Rafi' (may Allah be pleased with him) would go with him to Marwan (may Allah have mercy on him) and narrate the hadith of the Messenger of Allah (ﷺ) to him. So, Rafi' (may Allah be pleased with him) went with the man to Marwan (may Allah have mercy on him). Rafi' (may Allah be pleased with him) said: "O Marwan! Have you detained this man's slave?" He replied, "Yes." He asked, "What do you intend to decide regarding him?" He said, "I intend to cut off his hand." So Rafi' (may Allah be pleased with him) said: "I heard the Messenger of Allah (ﷺ) say: 'The hand is not to be cut off for stealing fruit or the stone of dates.'" So Marwan (may Allah have mercy on him) ordered the release of the slave.

Then Sayyiduna Rafi‘ bin Khadij (may Allah be pleased with him) was present there and said: The Prophet (ﷺ) said: “The hand is not to be cut off for stealing fruit or the pith.”

It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) addressed the people during a battle. Abdullah bin Umar (may Allah be pleased with him) says: I also went to listen, but the sermon had ended before I arrived. I asked the people, "What did the Messenger of Allah (peace and blessings be upon him) say?" They said that he (peace and blessings be upon him) forbade making nabidh (fermented drink) in gourds and in vessels coated with pitch.
