Hadith 3406
أَخْبَرَنَا سَعِيدٌ، نا إِبْرَاهِيمُ بْنُ سَعْدٍ، عَنِ ابْنِ شِهَابٍ، قَالَ: كَانَ عُمَرُ وَابْنُ عُمَرَ يَكْرَهَانِ الْعَزْلَ، وَكَانَ زَيْدُ بْنُ ثَابِتٍ وَابْنُ مَسْعُودٍ يَعْزِلَانِ "
Sayyiduna Umar and Sayyiduna Ibn Umar (may Allah be pleased with them both) disliked coitus interruptus, whereas Sayyiduna Zayd bin Thabit and Sayyiduna Ibn Mas'ud (may Allah be pleased with them both) practiced coitus interruptus.
Hadith 3407
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، نا يَحْيَى بْنُ سَعِيدٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، قَالَ: " كَانَ عُمَرُ وَعُثْمَانُ يَكْرَهَانِ الْعَزْلَ، وَيَقُولَانِ: مَنْ جَامَعَ فَأَكْسَلَ فَعَلَيْهِ الْغُسْلُ، وَكَانَ رِجَالٌ مِنَ الْأَنْصَارِ لَا يَرَوْنَ بِالْعَزْلِ بَأْسًا، وَيَقُولُونَ: مَنْ جَامَعَ ثُمَّ أَكْسَلَ فَلَا غُسْلَ عَلَيْهِ "
Sayyiduna Umar and Sayyiduna Uthman (may Allah be pleased with them both) disliked 'azl (withdrawal) and used to say: "If ejaculation occurs after intercourse, ghusl (ritual bath) becomes obligatory." Whereas some of the Ansar did not see any harm in 'azl and used to say: "If ejaculation does not occur, ghusl is not obligatory."
Hadith 3408
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا يَحْيَى بْنُ سَعِيدٍ، عَمَّنْ حَدَّثَهُ عَنْ زَيْدِ بْنِ ثَابِتٍ «أَنَّهُ كَانَ يَعْزِلُ عَنْ أُمِّ وَلَدٍ لَهُ، فَجَاءَتْ بِوَلَدٍ، فَعَرَفَ الشَّبَهَ، فَأَقَرَّ بِهِ»
Sayyiduna Zaid bin Thabit (may Allah be pleased with him) used to practice coitus interruptus with his slave woman, but when a child was born and he saw the resemblance, he accepted him as his son.
Hadith 3409
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا ابْنُ عَوْنٍ، نا نَافِعٌ، عَنِ ابْنِ عُمَرَ، «أَنَّهُ ضَرَبَ بَعْضَ وَلَدِهِ عَلَى الْعَزْلِ، وَكَانَ يَكْرَهُهُ»
Sayyiduna Ibn Umar (may Allah be pleased with them both) struck one of his sons for practicing coitus interruptus, and he disliked it.
Hadith 3410
أَخْبَرَنَا سَعِيدٌ، نَا جَرِيرٌ، عَنْ مَنْصُورٍ، عَنْ مُجَاهِدٍ، قَالَ: كَانَ لِابْنِ عَبَّاسٍ جَارِيَةٌ سَوْدَاءُ، وَكَانَ يَطَؤُهَا، وَيَعْزِلُ عَنْهَا، وَيَجْعَلُ مَاءَهُ فِي خِرْقَةٍ، وَيُرِيهَا إِيَّاهَا .
It is narrated about Sayyiduna Ibn Abbas (may Allah be pleased with them both) that he had a black slave woman, and he would have intercourse with her, and practice coitus interruptus, and would collect his semen in a cloth and show it to her.
Hadith 3411
أَخْبَرَنَا سَعِيدٌ، نَا أَبُو عَوَانَةَ، عَنْ سُلَيْمَانَ بْنِ أَبِي الْمُغِيرَةِ، قَالَ: سَأَلْتُ سَعِيدَ بْنَ جُبَيْرٍ عَنِ الْعَزْلِ، فَقَالَ: « كَانَ ابْنُ عُمَرَ يَكْرَهُهُ، وَعَنِ ابْنِ عَبَّاسٍ: لَا يَرَى بِهِ بَأْسًا » .
It was asked from Sayyiduna Sa'id bin Jubair (may Allah have mercy on him) about 'azl (withdrawal), so he said: "Sayyiduna Ibn 'Umar (may Allah be pleased with them both) used to dislike it, and Sayyiduna Ibn 'Abbas (may Allah be pleased with them both) said that there is no harm in it."
Hadith 3412
أَخْبَرَنَا سَعِيدٌ، نَا هُشَيْمٌ، أَنْبَأَ حُصَيْنٌ، عَنْ مُصْعَبِ بْنِ سَعْدٍ، قَالَ: حَدَّثَتْنِي أُمُّ وَلَدٍ لِسَعْدٍ أَنَّ سَعْدًا « كَانَ يَعْزِلُ عَنْهَا » .
Sa’d bin Abi Waqqas (may Allah be pleased with him) had a slave woman with whom he used to practice coitus interruptus (azl).
Hadith 3413
أَخْبَرَنَا سَعِيدٌ، نَا أَبُو عَوَانَةَ، عَنْ عُمَرَ بْنِ أَبِي سَلَمَةَ، عَنْ أَبِيهِ، عَنْ سَعْدٍ « أَنَّهُ كَانَ يَعْزِلُ » .
Sayyiduna Sa’d bin Abi Waqqas (may Allah be pleased with him) practiced coitus interruptus (azl).
Hadith 3414
أَخْبَرَنَا سَعِيدٌ، نَا هُشَيْمٌ، أَنَا إِسْمَاعِيلُ بْنُ سَالِمٍ، عَنِ الْمِنْهَالِ بْنِ عَمْرٍو، أَنَّ رَجُلًا سَأَلَ عَلِيًّا رَضِيَ اللهُ عَنْهُ عَنِ امْرَأَتِهِ وَهِيَ حَائِضٌ أَيَعْزِلُ عَنْهَا مَخَافَةَ الْوَلَدِ، فَرَخَّصَ لَهُ فِي ذَلِكَ .
A man asked Sayyiduna Ali (may Allah be pleased with him) about his wife who was menstruating, whether he could practice coitus interruptus (azl) so that pregnancy would not occur, so Sayyiduna Ali (may Allah be pleased with him) permitted him to do so.
Hadith 3415
أَخْبَرَنَا سَعِيدٌ، نَا هُشَيْمٌ، أَنَا عُبَيْدَةُ، عَنْ إِبْرَاهِيمَ، أَنَّهُ كَانَ يَقُولُ: « يَسْتَأْمِرُ الْحُرَّةَ وَلَا يَسْتَأْمِرُ الْأَمَةَ » .
Ibrahim (may Allah have mercy on him) said: "It is necessary to seek permission from a free woman, but it is not necessary to seek permission from a slave woman."
Hadith 3416
أَخْبَرَنَا سَعِيدٌ، نَا هُشَيْمٌ، أَنَا يَحْيَى بْنُ سَعِيدٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، أَنَّهُ قَالَ مِثْلَ ذَلِكَ .
Sayyiduna Sa'id bin al-Musayyib (may Allah have mercy on him) also said the same: "It is necessary to seek permission from a free woman."
Hadith 3417
أَخْبَرَنَا سَعِيدٌ، نَا هُشَيْمٌ، أَنَا أَبُو حُرَّةَ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ: « مَا عَلَيْكُمْ أَنْ تَحْبِسُوا ذَلِكَ » .
Hasan (may Allah have mercy on him) said: "There is no harm if you practice coitus interruptus (withdrawal)."
Hadith 3418
أَخْبَرَنَا سَعِيدٌ، نَا أَبُو عَوَانَةَ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، قَالَ: « يَعْزِلُ عَنِ الْأَمَةِ، وَيَسْتَأْمِرُ الْحُرَّةَ » .
Ibrahim (may Allah have mercy on him) said: "It is permissible to practice coitus interruptus with a slave woman, and it is necessary to seek permission from a free woman."
Hadith 3419
حَدَّثَنَا سَعِيدٌ، ثنا - أُرَاهُ سُفْيَانَ، نا عَمْرُو بْنُ دِينَارٍ، عَنْ عِكْرِمَةَ، قَالَ: «كَانَ سَعْدٌ وَزَيْدُ بْنُ ثَابِتٍ يَعْزِلَانِ»
Said bin Jubair (may Allah have mercy on him) said: "Sa'd and Zaid bin Thabit (may Allah be pleased with them both) used to practice coitus interruptus (azl)."
Hadith 3420
أَخْبَرَنَا سَعِيدٌ، نَا أَبُو مُعَاوِيَةَ، عَنِ الْأَعْمَشِ، عَنْ سَالِمِ بْنِ أَبِي الْجَعْدِ، عَنْ جَابِرٍ، قَالَ: أَتَى النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ رَجُلٌ مِنَ الْأَنْصَارِ فَقَالَ: إِنَّ خَادِمًا لِي تَسَنَّى عَلَى نَاقَةٍ لِي، وَأَنَا أَعْزِلُ عَنْهَا، فَحَمَلَتْ، فَقَالَ رَسُولُ اللهِ [7/132] صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: « مَا قَدَّرَ اللهُ أَنْ يَخْلُقَهَا إِلَّا وَهِيَ كَائِنَةٌ » .
It is narrated from Sayyiduna Jabir (may Allah be pleased with him) that a man came to the Noble Prophet (peace and blessings be upon him) and said: "One of my servants mounted my she-camel and practiced coitus interruptus (azl) with her, but she became pregnant." So the Messenger of Allah (peace and blessings be upon him) said: "What Allah has decreed will surely happen, and she was destined to become pregnant."
Hadith 3421
أَخْبَرَنَا سَعِيدٌ، نا أَبُو مُعَاوِيَةَ، عَنِ الْأَعْمَشِ، عَنْ سَالِمِ بْنِ أَبِي الْجَعْدِ، عَنْ جَابِرٍ، قَالَ: أَتَى النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ رَجُلٌ مِنَ الْأَنْصَارِ فَقَالَ: إِنَّ خَادِمًا لِي تَسَنَّى عَلَى نَاقَةٍ لِي، وَأَنَا أَعْزِلُ عَنْهَا، فَحَمَلَتْ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «مَا قَدَّرَ اللَّهُ أَنْ يَخْلُقَهَا إِلَّا وَهِيَ كَائِنَةٌ»
Sayyiduna Jabir (may Allah be pleased with him) said: "A man from the Ansar said, 'My servant mounted my she-camel and I practiced coitus interruptus with her, yet she became pregnant.' So the Prophet (peace and blessings of Allah be upon him) said: 'What Allah has decreed will surely happen.'"
Hadith 3422
أَخْبَرَنَا سَعِيدٌ، نا جَرِيرٌ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، فِي نَثْرِ السُّكَّرِ قَالَ: «كَانَ يَأْخُذُونَهُ لِلصِّبْيَانِ» أَخْبَرَنَا سَعِيدٌ، نا جَرِيرٌ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، أَنَّهُ كَرِهَهُ
Ibrahim Nakha'i (may Allah have mercy on him) said: "People used to sprinkle sugar for children, but Ibrahim Nakha'i (may Allah have mercy on him) considered it disliked."
Hadith 3423
أَخْبَرَنَا سَعِيدٌ، نا عِيسَى بْنُ يُونُسَ، نا الْأَعْمَشُ، عَنْ مُوسَى بْنِ عَبْدِ اللَّهِ الْخَطْمِيِّ، قَالَ: شَهِدْتُ عَبْدَ الرَّحْمَنِ بْنَ أَبِي لَيْلَى فِي مُلَاءٍ، فَجَاءُوا بِسُكَّرٍ، فَأَرَادُوا أَنْ يَنْثُرُوهُ، فَقَالَ عَبْدُ الرَّحْمَنِ: «ضَعُوهُ، ثُمَّ اقْتَسِمُوهُ»
Hazrat Abdur Rahman bin Abi Laila (may Allah have mercy on him) said: "Keep the sugar and distribute it among yourselves, and do not scatter it."
Hadith 3424
أَخْبَرَنَا سَعِيدٌ، نا سُفْيَانُ عَنْ حُصَيْنٍ عَنْ عِكْرِمَةَ قَالَ سَأَلُوهُ عَنْ نَثْرِ السُّكَّرِ قَالَ إِنْ وَضَعُوهُ وَضْعًا فَخُذُوهُ , وَإِنْ نَثَرُوهُ فَلَا تَأْخُذُوهُ
Sayyiduna Ikrimah (may Allah have mercy on him) said: "If sugar is placed (before you), then take it; if it is scattered (as an offering), then do not take it."
Hadith 3425
أَخْبَرَنَا سَعِيدٌ، أنا هُشَيْمٌ، أنا أَيُّوبُ السَّخْتِيَانِيُّ، وَعُبَيْدُ اللَّهِ بْنُ عُمَرَ، حَدَّثَانَا وَكَانَا جَالِسَيْنِ جَمِيعًا عَنْ نَافِعٍ، أَنَّ رَجُلًا مِنْ أَصْحَابِ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ زَوَّجَ أَمَةً لَهُ مِنْ غُلَامٍ لَهُ وَكَانَ يُخَالِفُ إِلَيْهَا، فَأَرْسَلَ عُمَرُ إِلَى الرَّجُلِ، فَقَالَ: مَا فَعَلَتْ أَمَتُكَ فُلَانَةُ؟ فَقَالَ: زَوَّجْتُهَا مِنْ غُلَامٍ لِي قَالَ: «فَهَلْ تَنَالُ مِنْهَا؟» فَأَوْمَى إِلَيْهِ الْقَوْمُ مِنْ خَلْفِ عُمَرَ: أَنْ قُلْ: لَا، فَقَالَ أَحَدُهُمَا: لَوْ قُلْتَ: نَعَمْ لَجَعَلَكَ نَكَالًا لِلْعَالَمِينَ، وَقَالَ الْآخَرُ: لَوْ قُلْتَ: نَعَمْ لَرَجَمَكَ
Sayyiduna Umar (may Allah be pleased with him) asked a companion: "You have married your slave woman to your slave, do you yourself also have relations with her?" If he had said yes, Umar (may Allah be pleased with him) would have given him a severe punishment.
Hadith 3426
أَخْبَرَنَا سَعِيدٌ، نا سُفْيَانُ، عَنْ مُطَرِّفٍ، عَنِ الشَّعْبِيِّ، قَالَ: قَالَ شُرَيْحٌ: «إِنِّي لَأَكْرَهُ أَنْ أَطَأَ امْرَأَةً لَوْ وَجَدْتُ مَعَهَا رَجُلًا لَمْ أُقِمْ عَلَيْهَا الْحَدَّ»
Hazrat Qazi Shurayh (may Allah have mercy on him) said: "I dislike having intercourse with such a woman that if I were to find her with another man, I would not be able to establish the legal punishment (hadd)."
Hadith 3427
أَخْبَرَنَا سَعِيدٌ، نا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، قَالَ: سُئِلَ شُرَيْحٌ عَنِ الْأَمَةِ إِذَا كَانَ لَهَا زَوْجٌ، فَقَالَ: «سَيْفَيْنِ فِي غِمْدٍ وَاحِدٍ»
Hazrat Qazi Shurayh (may Allah have mercy on him) was asked: "What if the slave-girl has a husband?" He replied: "This is like keeping two swords in one sheath (i.e., it is impermissible)."
Hadith 3428
أَخْبَرَنَا سَعِيدٌ، نا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ، أَنَّ عَبْدَ اللَّهِ بْنَ مَسْعُودٍ، اشْتَرَى مِنِ امْرَأَتِهِ جَارِيَةً، فَاشْتَرَطَتْ عَلَيْهِ: إِنْ هُوَ بَاعَهَا فَهِيَ أَحَقُّ بِهَا بِالثَّمَنِ، فَسَأَلَ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، فَقَالَ: «لَا تَقْرَبْهَا وَلِأَحَدٍ فِيهَا شَرْطٌ»
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) bought a slave girl from his wife and made a condition that if he sold her, the wife would have the right to buy her. When this was asked to Sayyiduna Umar (may Allah be pleased with him), he said: "As long as someone else's condition remains, do not benefit from it."
Hadith 3429
أَخْبَرَنَا سَعِيدٌ، نا سُفْيَانُ، عَنْ مِسْعَرٍ، عَنِ الْقَاسِمِ بْنِ عَبْدِ الرَّحْمَنِ، قَالَ: اشْتَرَى عَبْدُ اللَّهِ مِنِ امْرَأَتِهِ جَارِيَةً، وَاشْتَرَطَتْ خِدْمَتَهَا، فَسَأَلَ عُمَرَ فَقَالَ: «لَيْسَ مِنْ مَالِكَ مَا كَانَ فِيهِ شَرْطٌ لِغَيْرِكَ»
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) bought a slave girl from his wife, and the wife set the condition that she would serve her. When Sayyiduna Umar (may Allah be pleased with him) was asked, he said: "Any wealth in which someone else has a right is not your wealth."
Hadith 3430
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا يُونُسُ بْنُ عُبَيْدٍ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ «أَنَّهُ كَانَ يَكْرَهُ أَنْ يَشْتَرِيَ الرَّجُلُ الْأَمَةَ عَلَى أَنْ لَا تُبَاعَ وَلَا تُوهَبَ»
Sayyiduna Ibn Umar (may Allah be pleased with them both) disliked the purchase of a slave in which there was a condition that the slave-girl should neither be sold nor given away.
Hadith 3431
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا يُونُسُ، عَنِ الْحَسَنِ، وَمُغِيرَةَ، عَنْ إِبْرَاهِيمَ، أَنَّهُمَا قَالَا: «يَجُوزُ الْبَيْعُ وَيَبْطُلُ الشَّرْطُ»
Hasan and Ibrahim, may Allah have mercy on them, said: "The sale is valid, the condition is invalid."
Hadith 3432
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، ذُكِرَ لَهُ ذَلِكَ، فَقَالَ: «وَدِدْتُ أَنْ أَجِدَ جَارِيَةً اشْتَرِيهَا عَلَى هَذَا الشَّرْطِ، وَأَجْعَلَ لَهَا الْعِتْقَ»
Ismail bin Abi Khalid (may Allah have mercy on him) said: "I wished to buy a slave-girl with such a condition and then set her free."
Hadith 3433
أَخْبَرَنَا سَعِيدٌ، نا عِيسَى بْنُ يُونُسَ، نا الْأَوْزَاعِيُّ، قَالَ: " ابْتَعْتُ جَارِيَةً وَاشْتُرِطَ عَلَيَّ أَنْ لَا أَبِيعَ وَلَا أَهَبَ وَلَا أُمْهِرَ، فَإِذَا مُتُّ فَهِيَ حُرَّةٌ، فَسَأَلْتُ عَطَاءً - أَوْ سُئِلَ - فَكَرِهَهُ، وَسَأَلْتُ الْحَكَمَ بْنَ عُتَيْبَةَ قَالَ: لَيْسَ بِهِ بَأْسٌ، وَسَأَلْتُ مَكْحُولًا، فَقَالَ: لَا بَأْسَ بِهِ، فَقُلْتُ: أَتَخَافُ عَلَيَّ فِيهِ مَأْثَمًا؟ قَالَ: بَلْ أَرْجُو لَكَ فِيهِ أَجْرًا، وَسَأَلْتُ عَبْدَةَ بْنَ أَبِي لُبَابَةَ، فَقَالَ: هَذَا فَرْجُ سُوءٍ، وَقَالَ الْأَوْزَاعِيُّ: وَحَدَّثَنِي يَحْيَى بْنُ أَبِي كَثِيرٍ عَنِ الْحَسَنِ قَالَ: الْبَيْعُ جَائِزٌ وَالشَّرْطُ بَاطِلٌ، وَسَأَلْتُ الزُّهْرِيَّ، فَأَخْبَرَنِي أَنَّ ابْنَ مَسْعُودٍ كَتَبَ إِلَى عُمَرَ يَسْأَلُهُ عَنِ ابْتِيَاعِهِ مِنِ امْرَأَتِهِ جَارِيَةً عَلَى إِنْ بَاعَهَا فَهِيَ أَحَقُّ بِهَا بِالثَّمَنِ، فَقَالَ عُمَرُ: «لَا تَطَأْ فَرْجًا وَفِيهِ شَرْطٌ لِغَيْرِكَ»
Imam Awza'i (may Allah have mercy on him) said: "I bought a slave girl with the condition that I would neither sell her, nor gift her, nor give her in marriage, and that she would be set free upon my death. When I asked the scholars about this, some disliked it, some permitted it, and some said that there is reward for you in it."
Hadith 3434
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا أَبُو بِشْرٍ، عَنْ حَبِيبِ بْنِ سَالِمٍ، مَوْلَى النُّعْمَانِ بْنِ بَشِيرٍ قَالَ: جَاءَتِ امْرَأَةٌ إِلَى النُّعْمَانِ بِجَارِيَتِهَا، فَقَالَ: أَمَا إِنَّ عِنْدِي فِي ذَلِكَ خَبَرًا شَافِيًا أُحَدِّثُهُ عَنْ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «إِنْ كُنْتِ أَذِنْتِ لَهُ ضَرَبْتُهُ مِائَةً، وَإِنْ كُنْتِ لَمْ تَأْذَنِي لَهُ رَجَمْتُهُ» فَقَالَ لَهَا النَّاسُ: زَوْجُكِ وَأَبُو وَلَدِكِ يُرْجَمُ قُولِي: قَدْ كُنْتُ أَذِنْتُ لَهُ، وَإِنَّمَا حَمَلَنِي عَلَى ذَلِكَ الْغَيْرَةُ قَالَ: فَضَرَبَهُ مِائَةً
Hazrat Habib bin Salim, may Allah have mercy on him, who was the freed slave of Sayyiduna Nu'man bin Bashir, may Allah be pleased with him, narrates: A woman came to Sayyiduna Nu'man bin Bashir, may Allah be pleased with him, bringing her slave-girl with her. Sayyiduna Nu'man, may Allah be pleased with him, said: "I have a clear hadith of the Messenger of Allah, peace and blessings be upon him, regarding this matter. I will relate it to you: If you permitted this (man), I will give him one hundred lashes, and if you did not permit him, I will stone him (to death)." The people said to the woman: "He is your husband, the father of your children, will he be stoned? (Do not let this happen!) Say that you permitted him." So the woman said: "Yes, I permitted him, I only denied it out of jealousy." Thus, Sayyiduna Nu'man bin Bashir, may Allah be pleased with him, gave the man one hundred lashes.
Hadith 3435
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، نا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، قَالَ: أَخْبَرَنِي مُدْرِكُ بْنُ عُمَارَةَ بْنِ عُقْبَةَ أَنَّ مَوْلَاةً لَهُمْ أَتَتْ عَلِيًّا رَضِيَ اللَّهُ عَنْهُ، فَزَعَمَتْ أَنَّ زَوْجَهَا وَقَعَ بِجَارِيَتِهَا، فَقَالَ: «إِنْ تَكُونِي صَادِقَةً رَجَمْنَا زَوْجَكِ، وَإِنْ تَكُونِي كَاذِبَةً نَجْلِدْكِ ثَمَانِينَ»
A slave woman came to Sayyiduna Ali (may Allah be pleased with him) and complained that her husband had committed adultery with a slave woman. He said: "If you are truthful, we will stone your husband, and if you are lying, we will give you the prescribed lashes."
Hadith 3436
أَخْبَرَنَا سَعِيدٌ، قَالَ: نا هُشَيْمٌ، عَنْ مُغِيرَةَ، عَنِ الْهَيْثَمِ بْنِ بَدْرٍ، عَنْ حَرْقُوصِ بْنِ بَشِيرٍ الضَّبِّيِّ، قَالَ: " رُفِعَ رَجُلٌ وَقَعَ بِجَارِيَةِ امْرَأَتِهِ، فَقَالَ الرَّجُلُ: هِيَ امْرَأَتِي، وَمَالُهَا مَالِي، فَدَرَأَ عَنْهُ الْحَدَّ، وَقَالَ: أَمَا إِنْ عُدْتَ "
It is narrated from Harqus bin Basheer Dabi, may Allah have mercy on him, that a man committed adultery with a slave woman, but he said that she is the property of my wife and my property, so the hadd (prescribed punishment) was dropped, but he was warned that if he did it again, he would be given a severe punishment.
Hadith 3437
أَخْبَرَنَا سَعِيدٌ، نا عَبْدُ الرَّحْمَنِ بْنُ أَبِي الزِّنَادِ، عَنْ أَبِيهِ، عَنْ مُحَمَّدِ بْنِ حَمْزَةَ بْنِ عَمْرٍو، عَنْ أَبِيهِ، قَالَ: دَرَأَ عُمَرُ بْنُ الْخَطَّابِ عَنْ رَجُلٍ مِنَ الْأَعْرَابِ وَقَعَ بِجَارِيَةِ امْرَأَتِهِ الرَّجْمَ، وَجَلَدَهُ مِائَةً "
Sayyiduna Umar bin Al-Khattab (may Allah be pleased with him) did not stone to death a Bedouin who was involved in adultery with his wife's slave woman, rather he gave him one hundred lashes.
Hadith 3438
أَخْبَرَنَا سَعِيدٌ، نا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ، قَالَ: خَرَجَ رَجُلٌ بِجَارِيَةِ امْرَأَتِهِ فِي سَفَرٍ، فَمَرِضَ فَعَالَجَتْهُ، فَكَأَنَّهَا اطَّلَعَتْ مِنْهُ، فَاشْتَرَاهَا مِنْ نَفْسِهِ، ثُمَّ أَصَابَهَا، فَلَمَّا قَدِمَ انْطَلَقَتِ امْرَأَتُهُ، فَأَخْبَرَتْ عُمَرَ بْنَ الْخَطَّابِ، فَقَالَ عُمَرُ لِلرَّجُلِ: «ابْتَعْتَ إِحْدَى يَدَيْكَ عَلَى الْأُخْرَى، لَا تَنْفَلِتُ مِنِّي مِنْ أَحَدِ الْحَدَّيْنِ»
A man bought his wife's slave-girl during a journey and had intercourse with her. When he returned, his wife informed Sayyiduna Umar (may Allah be pleased with him). Umar (may Allah be pleased with him) said: "You have bought one of your own hands with the other; you will not escape the prescribed punishment."
Hadith 3439
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا يُونُسُ بْنُ عُبَيْدٍ قَالَ: نا الْحَسَنُ، عَنْ سَلَمَةَ بْنِ الْمُحَبِّقِ الْهُذَلِيِّ، أَنَّ رَجُلًا خَرَجَ فِي سَفَرٍ، فَبَعَثَتْ مَعَهُ امْرَأَتُهُ بِخَادِمٍ لَهَا تَخْدُمُهُ، فَوَقَعَ عَلَيْهَا فِي سَفَرِهِ، فَلَمَّا قَدِمَ ذَكَرَ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «إِنْ كُنْتَ اسْتَكْرَهْتَهَا فَهِيَ حُرَّةٌ وَعَلَيْكَ مِثْلُهَا لِمَوْلَاتِهَا، وَإِنْ كَانَتْ طَاوَعَتْكَ فَهِيَ أَمَةٌ وَعَلَيْكَ مِثْلُهَا»
It is narrated from Sayyiduna Salamah bin Muhabbaq Hudhali رضي الله عنه that the Messenger of Allah صلى الله عليه وسلم said: "If a slave girl has been forced, then she is free and a slave girl like her should be given in compensation, and if she has done it willingly, then she remains a slave girl and compensation must be given."
Hadith 3440
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مَنْصُورٌ، وَأَبُو حُرَّةَ، عَنِ الْحَسَنِ وَكَانَ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ رَجُلًا جَرِيئًا، وَكَانَ يَرَى عَلَيْهِ الرَّجْمَ
Hasan (may Allah have mercy on him) said: "Sayyiduna Ali (may Allah be pleased with him) was a courageous man, and if someone committed adultery with a slave woman, he would order stoning."
Hadith 3441
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا حُصَيْنٌ، وَإِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، عَنِ الشَّعْبِيِّ، قَالَ: جَاءَ رَجُلٌ إِلَى عَبْدِ اللَّهِ، فَقَالَ: إِنَّهُ وَطِئَ جَارِيَةَ امْرَأَتِهِ قَالَ عَبْدُ اللَّهِ: «اسْتَتِرْ بِسِتْرِ اللَّهِ، وَتُبْ إِلَى اللَّهِ، وَإِنِ اسْتَطَعْتَ أَنْ تَشْتَرِيَهَا وَتُعْتِقَهَا فَافْعَلْ» وَلَمْ يَرَ عَلَيْهِ حَدًّا
A man asked Abdullah bin Mas'ud (may Allah be pleased with him) that he had intercourse with his wife's slave-girl, so he replied: "Conceal yourself with Allah's covering, repent, and if possible, buy the slave-girl and set her free."
Hadith 3442
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مُجَالِدٌ، عَنِ الشَّعْبِيِّ، نا مَسْرُوقٌ، أَنَّ عَبْدَ اللَّهِ خَرَجَ مِنْ مَنْزِلِهِ ذَاتَ يَوْمٍ وَدَارُهُ مُمْتَلِئَةٌ مِنَ النَّاسِ، فَقَالَ: مَنْ جَاءَ مِنْكُمْ يَسْأَلُ عَنْ فَرِيضَةٍ أَوْ أَمْرٍ نَزَلَ بِهِ مِنْ حُكُومَةٍ أَوْ غَيْرِ ذَلِكَ فَلْيَتَنَحَّ، وَمَنْ كَانَ مِنْكُمْ جَاءَ لِيُطْلِعَنَا عَلَى أَمْرٍ قَدْ أَسَرَّهُ فَلْيُسِرَّ التَّوْبَةَ كَمَا أَسَرَّ الْخَطِيئَةَ؛ فَإِنَّا لَا نَمْلِكُ إِلَّا اللِّعَانَ، فَقَامَ إِلَيْهِ رَجُلٌ مِنْ بَنِي تَمِيمٍ، فَقَالَ: إِنَّ امْرَأَتَهُ وَإِنَّهَا مُشْتَبِكَةُ النَّسَبِ فِي الْحَيِّ، وَإِنَّهَا كَانَتْ تَسْتَأْذِنُنِي فِي الزِّيَارَةِ إِمَّا يَوْمَ يَحُجُّونَ، وَإِمَّا مَأْتَمٌ يَكُونُ فِيهِمْ أَوْ نَحْو ذَلِكَ، فَاسْتَأْذَنَتْنِي ذَاتَ يَوْمٍ، فَأَذِنْتُ لَهَا، فَلَمَّا خَلَا لِيَ الْبَيْتُ وَقَعْتُ عَلَى جَارِيَتِهَا، فَحَمَلَتْ، فَلَمَّا اسْتَبَانَ الْحَمْلُ قَالَتْ لِيَ امْرَأَتِي: إِنَّكَ ابْنُ عَمِّي، وَأَنَا أَكْرَهُ فَضِيحَتَكَ فَأْتِ بِقَوْمٍ مِنَ الْحَيِّ وَأَشْهِدْهُمْ أَنِّي قَدْ وَهَبْتُهَا لَكَ قَالَ: فَفَعَلْتُ، فَمَا التَّوْبَةُ مِمَّا صَنَعْتُ؟ وَمَا ثَوَابُهَا عَلَى مَا فَعَلَتْ؟ فَقَالَ عَبْدُ اللَّهِ: «اسْتَتِرْ بِسِتْرِ اللَّهِ، وَتُبْ إِلَى اللَّهِ، وَإِنِ اسْتَطَعْتَ أَنْ تَشْتَرِيَهَا، فَتُعْتِقَهَا، لَعَلَّ ذَلِكَ يُكَفِّرُ عَنْكَ مَا كَانَ مِنْكَ، وَأَمَّا ثَوَابُهَا فَأَعْطِهَا مِثْلَهَا»
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "Whoever repents should conceal the sin, and when a man mentioned committing adultery with his wife's slave-girl, he said: Repent, buy her and set her free, and reward your wife for this good deed."
Hadith 3443
أَخْبَرَنَا سَعِيدٌ، نا صَالِحُ بْنُ مُوسَى، قَالَ: نا مَنْصُورٌ، عَنْ إِبْرَاهِيمَ، قَالَ: قَالَ عَلْقَمَةُ: «مَا أُبَالِي أَتَيْتُ جَارِيَةَ امْرَأَتِي أَوْ جَارِيَةَ عَوْسَجَةَ» لِجَارٍ لَهُ مِنَ النَّخَعِ
Hazrat Alqamah (may Allah have mercy on him) said: "I do not care whether I have relations with my wife's slave-girl or my neighbor's slave-girl."
Hadith 3444
أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، عَنِ الشَّعْبِيِّ، وَمُغِيرَةَ، عَنْ إِبْرَاهِيمَ، قَالَ: قَالَ عَلْقَمَةُ: «مَا أُبَالِي أَجَارِيَةُ امْرَأَتِي وَطِئْتُ، أَوْ جَارِيَةُ عَوْسَجَةَ» يَعْنِي جَارِيَةَ جَارٍ لَهُ
Hazrat Alqamah (may Allah have mercy on him) said: "It makes no difference to me whether I have relations with my wife's slave-girl or with the neighbor's."
Hadith 3445
أَخْبَرَنَا سَعِيدٌ، نَا هُشَيْمٌ، أَنَا عُبَيْدَةُ، أَنَا إِبْرَاهِيمُ، عَنْ أَبِي مَسْعُودٍ [7/139] الْأَنْصَارِيِّ، قَالَ: « لَسَهْمٌ فِي كِنَانَتِي أَحَبُّ إِلَيَّ مِنْ جَارِيَةٍ حَسْنَاءَ لِامْرَأَتِي » .
Sayyiduna Abu Mas'ud Ansari (may Allah be pleased with him) said: "One arrow in my quiver is more beloved to me than the beautiful slave-girl of my wife."
