Hadith 1977

أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ خَالِدٍ، حَدَّثَنَا مَالِكُ بْنُ أَنَسٍ، عَنْ ابْنِ شِهَابٍ، عَنْ أَنَسِ بْنِ مَالِكٍ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ دَخَلَ مَكَّةَ عَامَ الْفَتْحِ وَعَلَى رَأْسِهِ مِغْفَرٌ، فَلَمَّا نَزَعَهُ جَاءَهُ رَجُلٌ، فَقَالَ: يَا رَسُولَ اللَّهِ، هَذَا ابْنُ خَطَلٍ مُتَعَلِّقٌ بِأَسْتَارِ الْكَعْبَةِ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "اقْتُلُوهُ" . قَالَ عَبْدُ اللَّهِ بْنُ خَالِدٍ: وَقُرِئَ عَلَى مَالِكٍ: قَالَ: قَالَ ابْنُ شِهَابٍ: وَلَمْ يَكُنْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَوْمَئِذٍ مُحْرِمًا.
It is narrated from Sayyiduna Anas bin Malik, may Allah be pleased with him, that when the Messenger of Allah, peace and blessings be upon him, entered Makkah on the day of the conquest of Makkah, he was wearing a helmet on his head. When he took it off, a man came and said: O Messenger of Allah! This is Ibn Khatal who is hanging onto the curtains of the Ka'bah. The Prophet, peace and blessings be upon him, said: "Kill him." Abdullah bin Khalid said: It was recited to Imam Malik, may Allah have mercy on him, and he said: Ibn Shihab said: On that day, the Messenger of Allah, peace and blessings be upon him, had not entered into the state of Ihram.

Brief Explanation
(Commentary on Hadith 1976)

From this narration, it is understood that in a time of necessity, one may enter Makkah without the ihram. Killing within the Haram is prohibited, but this Ibn Khatal, whose name was Abdullah, had become an apostate, killed a Muslim slave, refused to give zakat, and kept two slave girls who would sing satirical songs against the Prophet sallallahu alayhi wa sallam at his behest and for his listening. For these reasons, he was liable to be killed, and he was executed within the Sacred Sanctuary (Haram) itself.
