Hadith 1978

أَخْبَرَنَا إِسْمَاعِيل بْنُ أَبَانَ، حَدَّثَنَا مُعَاوِيَةُ بْنُ عَمَّارٍ الدُّهْنِيُّ، عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ، قَالَ: "دَخَلَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَكَّةَ حِينَ افْتَتَحَهَا وَعَلَيْهِ عِمَامَةٌ سَوْدَاءُ بِغَيْرِ إِحْرَامٍ" . قَالَ إِسْمَاعِيل: سَمِعَهُ مِنْ أَبِي الزُّبَيْرِ . كَانَ مَعَ أَبِيهِ.
It is narrated from Sayyiduna Jabir (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) entered Makkah on the day Makkah was conquered; he (peace be upon him) was without ihram and had a black turban on his head. Isma'il said: He heard this from Abu az-Zubair, and he was with his father.

Brief Explanation
(Commentary on Hadith 1977)

In the first narration, it is mentioned that when the Messenger of Allah sallallahu alayhi wa sallam entered Makkah, there was a helmet (mighfar) on his head. In the second narration, it is stated that there was a turban (‘imamah) on his head. The way to reconcile both narrations is that when he entered Makkah, there was a helmet on his head, then he removed it and put on a turban. Furthermore, these ahadith prove that if one does not intend Hajj or ‘Umrah, it is permissible to enter Makkah without the ihram. Therefore, drivers, shepherds, and those in need who come and go daily may enter the boundaries of the Haram and Makkah without ihram. Some scholars have prohibited this, but in light of authentic ahadith, their opinion is neither practicable nor authoritative.
