Hadith 35068
٣٥٠٦٨ - حدثنا عبدة بن سليمان عن ابن أبي عروبة عن قتادة قال: سئل علي عن مكاتب سباه العدو ثم اشتراه رجل من المسلمين قال: فقال: (إن) (١) أحب مولاه أن يفكه فيكون عنده على ما بقي من مكاتبته ويكون له الولاء، وإن كره ذلك كان عند الذي اشتراه على (هذا) (٢) الحال (٣).
Hazrat Qatadah (may Allah have mercy on him) narrates that Hazrat Ali (may Allah be pleased with him) was asked about a mukatab slave who had been captured by the enemy, and then a man from among the Muslims bought him. What is the ruling regarding him now? He (may Allah be pleased with him) replied: If his master wishes, he can ransom him by giving him as collateral, and then this slave will remain with his master in such a way that he will pay the remaining amount of his contract of manumission. And the master will receive the slave’s wala (right of inheritance). And if he does not wish to do so, then the slave will remain with the buyer in the same condition.
Hadith 35069
٣٥٠٦٩ - حدثنا الفضل بن دكين قال: ثنا عباد قال: أخبرني مكحول قال: في مكاتب أسره العدو فاشتراه رجل من التجار (فكاتبه) (١) قال: يؤدي (مكاتبة) (٢) الأول ثم يؤدي (مكاتبة) (٣) الآخر.
Hazrat ‘Abad (may Allah be pleased with him) narrates that Hazrat Mak’hool (may Allah have mercy on him) said: Regarding a mukatab slave who was captured by the enemy, and then a merchant bought him and made him a mukatab again, what will be the ruling? He (may Allah have mercy on him) said: The slave will first pay the amount of kitabah to the first master, and then he will pay the amount of kitabah to the second merchant.
