Musannaf Ibn Abi Shaybah

Amr bin Shu'aib narrates that Abu Qatadah, who was a man from Banu Mudlij, killed his own son. Hazrat Umar (may Allah be pleased with him) took one hundred camels from him in compensation: thirty three-year-old camels, thirty four-year-old camels, and forty pregnant she-camels. And he said to the father of the slain, "I heard from the Messenger of Allah (peace and blessings be upon him) that the killer has no inheritance."

Mujahid states that Hazrat Umar (may Allah be pleased with him) said, "The killer will not be an heir."

Shu'bi narrates that Hazrat Umar (may Allah be pleased with him) said: Neither the one who kills intentionally will be an heir, nor the one who kills by mistake.

Saeed bin Jubair narrates that a man killed his brother by mistake, so regarding this matter, Hazrat Ibn Abbas (may Allah be pleased with them) was asked: He replied: A killer does not inherit anything.

Saeed bin Musayyib narrates that the Noble Prophet (peace and blessings be upon him) gave this ruling: Whoever kills someone, whether intentionally or by mistake, will not inherit the blood money (diyah) of the slain person. And Zuhri says: The killer will not inherit anything from the slain person, whether he is his son or his father. However, he will inherit from the slain person’s own wealth, because Allah Almighty knows that people will kill one another, and no one has the right to abolish those inheritances which Allah Almighty has prescribed.

Abu Amr Abdi narrates this statement of Hazrat Ali (may Allah be pleased with him) that the killer will not be an heir.

Hajjaj narrates that Hazrat Ata said, "The killer will not inherit the blood money of the murdered person."

Yunus narrates that Hasan did not make the killer an heir, and his opinion was that the killer is barred.

Ibn Abi Dhi'b says that I asked Ibn Shihab, "Will a murderer inherit anything?" He replied, "Hazrat Sa'id bin al-Musayyib has said that it is established in the hadith that a murderer does not inherit anything."

Abdul Wahid bin Abi Aun narrates that Muhammad bin Jubair said: Whoever kills intentionally will not inherit blood money or any other property, and whoever kills by mistake will not inherit blood money, but if there is any other property, he will inherit it.

Yahya bin Saeed narrates the statement of Hazrat Urwah that the killer will not be an heir.

Hisham narrates from his father, he said, that the murderer will not inherit any portion of the wealth.

Abu Ghaniyyah narrates that Hazrat Hakam said: When a man kills his son or brother, he will not be his heir; apart from him, the person who is closer to the deceased will be his heir.

Ibn Jurayj narrates from Hazrat Ata that he said: If the killer kills by mistake, then he will inherit from the deceased's property but not from the deceased's blood money. However, if he kills intentionally, then he will neither inherit from his property nor from his blood money.

Muammar narrates that Zuhri said, when a person mistakenly kills his guardian, he will not inherit his wealth.

Yahya bin Abi Kathir narrates that Hazrat Ali (may Allah be pleased with him) said about the man who killed his mother, that if he killed her by mistake, he will be an heir, and if he killed her intentionally, he will not be an heir. Waki’ says that both the one who kills intentionally and the one who kills by mistake will inherit the blood money, not the property.

Mansur narrates that Ibrahim said: The killer will not be an heir.

Mansur narrates that the killer will not inherit the blood money of the murdered person, nor his property.

Sufyan narrates from a man the statement of Hazrat Qasim, that the killer will not be an heir.

Laith narrates from Hazrat Tawus that the killer will not be an heir.
