Hadith 33501
٣٣٥٠١ - حدثنا جرير عن ليث عن حماد عن إبراهيم قال: لم يكن أبو بكر وعمر (وعثمان) (١) يورثون (الحميل) (٢) (٣).
Ibrahim states that Hazrat Abu Bakr (may Allah be pleased with him) and Hazrat Umar (may Allah be pleased with him) used to make such brought-in children heirs.
Hadith 33502
٣٣٥٠٢ - حدثنا حفص عن أبي طلق عن أبيه قال: أدركت الحملاء في زمان علي وعثمان لا يورثون (١).
Abu Taliq's father narrates that during the time of Hazrat Ali (may Allah be pleased with him) and Hazrat Uthman (may Allah be pleased with him), I saw that children brought from the land of disbelief were not made heirs.
Hadith 33503
٣٣٥٠٣ - حدثنا ابن إدريس عن هشام عن الحسن وابن سيرين قالا: ما يورث (الحميل) (١) إلا ببينة.
Hisham narrates that Hasan and Ibn Sirin state that children brought from the land of disbelief cannot be made heirs without witnesses.
Hadith 33504
٣٣٥٠٤ - حدثنا وكيع قال: ثنا علي بن (مبارك) (١) عن يحيى بن أبي كثير عن ⦗٣٤٤⦘ محمد بن عبد الرحمن بن ثوبان أن عمر كتب: (٢) لا يورث بولادة الشرك (٣).
Muhammad bin Abdur Rahman bin Thawban narrates that Hazrat Umar (may Allah be pleased with him) had written that the children of the polytheists should not be made heirs.
Hadith 33505
٣٣٥٠٥ - حدثنا ابن نمير قال: ثنا (مجالد) (١) عن الشعبي قال: كتب إلى شريح أن لا يورث حميل إلا ببينة (٢).
Shu'bi narrates that Hazrat Umar (may Allah be pleased with him) wrote to Hazrat Shurayh that children brought from Dar al-Kufr should not be made heirs without witnesses.
Hadith 33506
٣٣٥٠٦ - حدثنا محمد بن أبي عدي عن ابن عون قال: ذكر لمحمد أن عمر بن عبد العزيز كتب في الحملاء: لا يورثون إلا بشهادة الشهود، قال: فقال محمد: قد توارث المهاجرون والأنصار بنسبهم الذي كان في الجاهلية، فأنا أنكر أن يكون عمر كتب بهذا.
Ibn Aun reports that it was mentioned to Muhammad (may Allah have mercy on him) that Umar ibn Abdul Aziz (may Allah have mercy on him) had written regarding children brought from the land of disbelief that they should not be made heirs without the testimony of witnesses. Upon this, he said that the Muhajirun and Ansar were made heirs on the basis of lineage from the time of ignorance, so I do not accept that he wrote this.
Hadith 33507
٣٣٥٠٧ - حدثنا جرير عن مغيرة عن إبراهيم قال: كانوا يتوارثون بالأرحام التي يتواصلون بها.
Mughira narrates that Ibrahim said that people used to be made heirs on the basis of those relationships through which they maintained ties of kinship.
Hadith 33508
٣٣٥٠٨ - حدثنا جرير عن الأعمش عن إياس بن عباس (عن) (١) شيخ من قومه أن أبا سليمان (غرق) (٢) أخ له (يقال) (٣) له: راشد، فاختصم فيه بنو زبيد وبنو أسد فارتفعوا إلى مسروق، فقال مسروق لبني أسد: (أتشهدون) (٤) أنه كان يحرم (منه) (٥) ما يحرم الأخ من أخته، فشهدوا بذلك، فأعطى أبا سليمان ميراثه.
Iyas bin Abbas narrates through an elder of his tribe that Abu Sulaiman had a brother whose name was Rashid, who passed away. There was a dispute between Banu Zubaid and Banu Asad regarding him. They brought this matter to Hazrat Masruq, so Hazrat Masruq said to Banu Asad: Do you testify that whatever is forbidden between a brother and sister was also forbidden between them? They testified to this, so he gave the inheritance to Abu Sulaiman.
Hadith 33509
٣٣٥٠٩ - حدثنا وكيع قال: سمعت الأعمش قال: كان أبي حميلًا فمات أخوه، فورثه مسروق منه.
Waki’ says that I heard this from A’mash, that he said: My father was brought from the land of disbelief in his childhood, then his brother died, so Hazrat Masruq made him the heir of his brother.
Hadith 33510
٣٣٥١٠ - حدثنا وكيع قال: ثنا سفيان عن حماد عن إبراهيم قال: قال عمر: كل نسب (يتواصل) (١) عليه في الإسلام فهو وارث موروث (٢).
Ibrahim reports that Hazrat Umar (may Allah be pleased with him) said: Every lineage on the basis of which ties of kinship are maintained in Islam, people will inherit on that basis, and others will be made their heirs on the same basis.
Hadith 33511
٣٣٥١١ - حدثنا ابن إدريس عن أشعث عن الشعبي قال: إذا كان نسبًا معروفًا موصولًا ورث -يعني الحميل.
Ash'ath narrates that Hazrat Sha'bi said: When the lineage of children brought from the land of disbelief is known, and relationships are maintained on that basis, then they will be heirs.
Hadith 33512
٣٣٥١٢ - حدثنا وكيع عن شعبة قال: سألت الحكم وحمادًا عن الحميل فقالا: لا يرث إلا ببينة.
Shu’bah says: I asked Hazrat Hakam and Hammad (may Allah have mercy on them) about children brought from Dar al-Kufr, and they said: He will not be an heir without testimony.
Hadith 33513
٣٣٥١٣ - حدثنا عبد الرحيم بن عبد الرحمن المحاربي قال: ثنا زائدة بن قدامة قال: ثنا أشعث بن أبي الشعثاء قال: أقرت امرأة من (١) محارب (جليبة) (٢) بنسب أخ لها (جليب) (٣) فورثه (عبد الرحمن) (٤) بن عتبة من أخته.
Ash'ath bin Abu Sha'sha reports that a woman from the tribe of Muharib, who had been brought from the land of disbelief in her childhood, testified to the lineage of her brother who had also been brought from the land of disbelief. Consequently, 'Abdur Rahman bin 'Utbah made that brother the heir to his sister.
Hadith 33514
٣٣٥١٤ - حدثنا وكيع قال: ثنا الحكم بن عطية قال: سألت الحسن عن الحميل يقيم البينة أنه أخوه، قال: يرثه في كتاب اللَّه: ﴿(وَأُولُو) (١) الْأَرْحَامِ بَعْضُهُمْ أَوْلَى بِبَعْضٍ فِي كِتَابِ اللَّهِ﴾ [الأنفال: ٧٥].
Hakam bin Atiyyah says that I asked Hasan about the child who brings witnesses that he is the brother of the deceased. He replied that according to Allah Almighty’s decision, he will be his heir. Allah Almighty says { وَأُولُوا الأَرْحَامِ بَعْضُہُمْ أَوْلَی بِبَعْضٍ فِی کِتَابِ اللہِ }.
