Musannaf Ibn Abi Shaybah

Ibrahim narrates that Hazrat Abdullah (may Allah be pleased with him) said regarding the case of a daughter, a sister, and a grandfather that the daughter should be given half of the wealth, and the remaining wealth should be divided equally between the grandfather and the sister. And he was asked about the case of a daughter, two sisters, and a grandfather, so he decided that half of the wealth should be given to the daughter, and the remaining wealth should be divided equally between the grandfather and the two sisters. And on one occasion, he was asked about the case of a daughter, three sisters, and a grandfather, so he decided that the daughter should be given half of the wealth, the grandfather should be given two-fifths of the remaining wealth, and each sister should be given one-fifth.

It is narrated from Ibrahim that Hazrat ‘Ubaidah, regarding the issue of the daughter, sister, and grandfather, said: This will be divided into four shares—two shares for the daughter, one share for the grandfather, and one share for the sister. The narrator says that I asked Ibrahim: What if there are two sisters instead of one? He replied: Hazrat ‘Ubaidah also divided this into four shares—two shares for the daughter, one share for the grandfather, and one share for both sisters. The narrator says: I asked Ibrahim: What if there are three sisters? He replied: Hazrat Masruq divided this issue into ten shares—five shares for the daughter, two shares for the grandfather, and one share for each sister.

Ibrahim narrates through another chain that Hazrat Masruq, regarding the issue of a daughter, three sisters, and a grandfather, said that this issue will be divided into ten shares: five shares, that is, half of the wealth, for the daughter; two shares for the grandfather; and one share for each sister.

Ibrahim narrates from Hazrat 'Abidah regarding the issue of daughter, sister, and grandfather that it will be divided into four shares: two shares, that is, half of the wealth for the daughter, one share for the grandfather, and one share for the sister.

Ibrahim narrates from Hazrat Masruq regarding the issue of a daughter, two sisters, and a grandfather, he said that this issue will be divided into eight shares: for the daughter, half of the wealth, that is, four shares; for the grandfather, two shares; and for each sister, one share.

Fazil Ibrahim narrates that if a man leaves behind his daughter, real sister, and grandfather, then according to the statement of Hazrat Ali (may Allah be pleased with him), his daughter will receive half of the estate, his grandfather will receive one-sixth, and the remainder will be given to his sister. And he (Ali) would not give the grandfather more than one-sixth in the presence of descendants. According to the statement of Hazrat Abdullah (may Allah be pleased with him), his daughter will receive half of the estate, and the remainder will be divided between the sister and the grandfather. And if there are two sisters (instead of one), then according to the statements of Hazrat Abdullah (may Allah be pleased with him) and Zaid (may Allah be pleased with him), the remainder will be divided between the sisters and the grandfather. And according to the statement of Hazrat Ali (may Allah be pleased with him), the grandfather will receive one-sixth of the estate, and the remainder will be for both sisters. And if there are three sisters, along with a daughter and a grandfather, then the daughter will receive half of the estate, and according to the statements of Hazrat Abdullah (may Allah be pleased with him) and Zaid (may Allah be pleased with him), the grandfather will receive two-fifths (2/5) of the remainder, and the sisters will receive the remaining three-fifths. Hazrat Abu Bakr states that this issue, according to the statement of Hazrat Ali (may Allah be pleased with him), will be resolved from ten shares: five shares for the daughter, two shares for the grandfather, and one share each for the sisters.

Fitr says that I asked Hazrat Sha’bi whether this statement is also found in the saying of Hazrat Abdullah (may Allah be pleased with him).
