The Mukatab Who Makes a Bequest, Gift, or Frees a Slave—Is It Permissible?
Hadith 32872
٣٢٨٧٢ - حدثنا ابن مبارك عن صالح بن خوات عن عبد اللَّه بن أبي بكر أن عمر بن عبد العزيز كتب أن المكاتب لا تجوز له وصية ولا هبة إلا بإذن مولاه.
It is narrated from Abdullah bin Abi Bakr that Umar bin Abdul Aziz wrote that it is not permissible for a mukatab to make a will without the permission of his master.
Hadith 32873
٣٢٨٧٣ - حدثنا ابن أبي عدي عن أشعث عن الحسن قال: المكاتب لا يعتق ولا يهب إلا بإذن مولاه.
It is narrated from Ash'ath (may Allah have mercy on him) that Hasan said: A mukatab (contracted slave) cannot free a slave nor give a gift without the permission of his master.
