Musannaf Ibn Abi Shaybah

Yunus Hasan narrates that it was said: When a person makes one will and then makes another will afterwards, the second will shall be acted upon.

Amr bin Dinar narrates from Hazrat Ata, Tawus, and Abu Al-Sha’sha that they said: The last will of such a person shall be acted upon.

Hisham Hasan narrates that a man made a will, and after gathering people, said: If I die, I make you witnesses that my such-and-such slave is free. He was told: You have freed such-and-such slave, but you left the other such-and-such slave who served you more. Upon this, he said: Call the people again! And said to them: I make you witnesses that I have revoked the freedom of that slave, and the other such-and-such slave is free if I die. So, that man died, and the first slave claimed that he was free, and the second said that he was free. So, they went to Abdul Malik bin Marwan for a decision, and he rejected the freedom of the first slave and declared the freedom of the second slave.

Muammar narrates from Zuhri that when a person makes a will and then cancels it and makes another will, only the second will shall be considered valid. And if he does not cancel the first will, then both wills shall be executed from one-third of his estate in proportion to their respective shares.

It is narrated from Amr bin Shu'aib that Ibn Abi Rabee'ah asked Hazrat Umar bin Khattab about a man who made one will and then made another will. He replied that the last of the two wills is more deserving to be executed.
