Regarding the Muslim Who Steals the Wine of a Dhimmi: Is His Hand Cut?
Hadith 30307
٣٠٣٠٧ - حدثنا أبو بكر قال: حدثنا بن عيينة عن سعيد (بن سعيد) (١) عن عطاء قال: إذا سرق المسلم من الذمي خمرًا قطع، وإذا سرقها من مسلم لم يقطع.
Hazrat Saeed bin Saeed narrates that Hazrat Ata said: If a Muslim steals the wine of a Dhimmi, his hand will be cut off, but if he steals the wine of a Muslim, his hand will not be cut off.
Hadith 30308
٣٠٣٠٨ - حدثنا أبو بكر قال: (حدثنا) (١) حفص عن مجالد عن عامر أن شريحًا ضمن مسلمًا خمرًا أهراقها لذمي.
Hazrat Aamir narrates that Hazrat Shurayh made a Muslim the guarantor for wine which he had borrowed from a Dhimmi.
Hadith 30309
٣٠٣٠٩ - حدثنا أبو بكر قال: حدثنا الضحاك بن مخلد عن أشعث عن الحسن قال: من سرق من يهودي أو نصراني أو أخذ من أهل الذمة قطع.
Hazrat Ash'ath narrates that Hasan Basri said: Whoever steals from a Jew or a Christian, or takes from a Dhimmi, his hand will be cut off.
