Musannaf Ibn Abi Shaybah

Hazrat Sha’bah states that I asked Hazrat Hakam and Hazrat Hammad about a person who ordered another man to kill someone. Both of them said: The killer will be killed (in retribution), and there will be no qisas (retaliation) upon the one who gave the order.

Hazrat Jabir narrates that a man ordered his slave, so the slave intentionally killed a man. Hazrat Amir said: This slave will be killed.

Hazrat Mansur says that Ibrahim stated regarding a person who ordered another man, and then he killed (someone), that both of them will be considered partners. Hazrat Waki’ said: According to us, they will be partners in the sin, but as for retribution (qisas), it will be upon the killer.

Hazrat Mansur says that I asked Ibrahim about a ruler who ordered a man, and then he killed someone. He replied: Both of them share in the sin.

Hazrat Salamah bin Nabi (may Allah be pleased with him) narrates that a ruler ordered a man to kill a particular person, so Hazrat Dhahhak bin Muzahim said: "Then you too will be killed."

Hazrat Ash'ath narrates that a man ordered his slave, and the slave killed a man. Hasan Basri said: That man will be killed.

Hazrat Khallas narrates that a man ordered his slave to kill a certain person. Hazrat Ali (may Allah be pleased with him) said: Surely, he (the slave) is like his whip or his sword.

Hazrat Ata says that a man ordered his slave, and so the slave killed someone. Then Hazrat Abu Hurairah said: The master will be killed.
