Musannaf Ibn Abi Shaybah

Hazrat Abu Juhaifah narrates that we asked Hazrat Ali (may Allah be pleased with him), "Do you have any hadith or anything else from the Messenger of Allah (peace and blessings be upon him) besides the Noble Qur'an?" Upon this, he replied, "No! By the One Who created the grain and brought every living being into existence, except for what Allah has granted a man understanding of in the Noble Qur'an, and what is in this scroll." The narrator says, "I asked, 'What is in this scroll?'" He replied, "The rulings of blood money, the freeing of captives, and that no Muslim will be killed in retaliation for a disbeliever."

Hazrat Abdullah bin Amr narrates that the Noble Prophet (peace and blessings be upon him) said: No believer will be killed in retaliation for a disbeliever.

It is narrated from Hazrat Ata that the Messenger of Allah, peace and blessings be upon him, said: No Muslim will be killed in retaliation for a disbeliever, nor will any covenant-holder be killed during the period of his agreement.

Hazrat Qatadah narrates that Hazrat Abu Al-Malih said: A man from my tribe killed a Jewish man by shooting an arrow at him. This matter was presented before Hazrat Umar bin Khattab, so he imposed a compensation of four thousand dirhams on that person and did not execute him in retaliation.

Hazrat Hisham narrates that Hasan Basri was asked about a person who had killed a Jew or a Christian. He replied: A believer will not be killed in retaliation for a disbeliever, even if the believer killed him intentionally.

Hazrat Abdul Malik states that Hazrat Ata said: A Muslim man will not be killed in retribution (qisas) for a Jew or a Christian, but he will be held responsible for the payment of blood money (diyat).

Hazrat Aamir narrates that Hazrat Ali (may Allah be pleased with him) said: It is from the Sunnah that a believer should not be killed in retaliation for a disbeliever, nor a free man in retaliation for a slave.
