Hadith 23116
٢٣١١٦ - حدثنا أبو بكر قال: حدثنا عيسى بن يونس عن الأوزاعي قال: ابتعت جارية وشرط عليَّ أهلها أن لا أبيع ولا أهب ولا أمهر، فإذا مت فهي حرة، فسألت الحكم بن (عتيبة) (١) فقال: لا بأس به.
It is narrated from Hazrat Awza’i that I bought a slave-girl and her people put a condition on me that I would neither sell her, nor gift her, nor give her in marriage as mahr; if I die, she will be free. I asked Hazrat Hakam bin Utaybah about this matter. He said: There is no harm. I asked Hazrat Mak’hool (may Allah have mercy on him), and he said: There is no harm. I said: Do you have any concern for me? He replied: Why not, I hope for two rewards for you. I asked Hazrat Ata (may Allah have mercy on him), and he disliked it. Hazrat Awza’i (may Allah have mercy on him) says that Hazrat Hasan (may Allah be pleased with him) says that selling is permissible and this condition is invalid. I asked Hazrat Abda bin Abu Lubabah, and he said: This is an evil private part (thing). I asked Zuhri, and he told me that Ibn Mas’ud (may Allah be pleased with him) asked Umar (may Allah be pleased with him) by letter about the ruling of a slave-girl whom he had bought from his wife on the condition that if I sell her, you will be entitled to her price. So Umar (may Allah be pleased with him) replied: You cannot have intercourse with such a private part in which someone else also has a right.
Hadith 23122
٢٣١٢٢ - حدثنا أبو بكر قال: حدثنا وكيع وابن أبي زائدة عن مسعر عن القاسم قال: قال عمر: ليس من مالك ما كان فيه (مثنوية) (١) لغيرك (٢).
It is narrated from Hazrat Qasim (may Allah have mercy on him) that Hazrat Umar (may Allah be pleased with him) said: That is not from your wealth in which someone other than you has a double share.
Hadith 23123
٢٣١٢٣ - حدثنا أبو بكر قال: حدثنا وكيع عن سفيان عن عاصم بن (عبيد اللَّه) (١) عن القاسم عن عائشة أنها كرهت أن تباع الجارية بشرط (٢) أن لا تباع (٣).
Hazrat Aisha (may Allah be pleased with her) disliked that a slave-girl be sold with the condition that she will not be sold further.
Hadith 23124
٢٣١٢٤ - حدثنا أبو بكر قال: حدثنا عبد السلام بن حرب عن (خصيف) (١) عن سعيد بن جبير في الرجل يشتري الجارية على أن لا يبيع ولا (يهب) (٢)، قال: لا يقربها.
Hazrat Saeed bin Jubair (may Allah have mercy on him) was asked that if a person buys a slave-girl on the condition that he will neither sell her nor give her as a gift, he (may Allah have mercy on him) replied: He will not approach her.
Hadith 23125
٢٣١٢٥ - حدثنا أبو بكر قال: حدثنا ابن مهدي عن حماد بن سلمة عن هشام ابن عروة عن أبيه أنه كرهها.
Hazrat Urwah (may Allah be pleased with him) used to dislike this.
Hadith 23126
٢٣١٢٦ - [حدثنا أبو بكر قال: حدثنا ابن نمير عن عبيد اللَّه بن عمر عن نافع عن ابن عمر أنه كان يقول: لا (يطأ) (١) فرجا فيه] (٢) شرط (٣).
Hazrat Ibn Umar (may Allah be pleased with them both) narrates that do not have intercourse in such a private part in which there is any condition.
Hadith 23127
٢٣١٢٧ - حدثنا أبو بكر قال: حدثنا ابن فضيل عن الحسن بن عبيد اللَّه عن إبراهيم في الرجل يشتري الجارية على أن لا يبيع ولا يهب، قال: ليس بشيء.
Ibrahim (may Allah have mercy on him) was asked about a person who buys a slave-girl on the condition that he will neither sell her nor give her as a gift. He (may Allah have mercy on him) said: This is nothing.
Hadith 23128
٢٣١٢٨ - (حدثنا أبو بكر) (١) قال: حدثنا ابن أبي زائدة عن إسماعيل بن أبي (خالد) (٢) عن الشعبي في الرجل يشتري الجارية على أن لا يبيع (ولا يهب) (٣) ولا يمهر، قال: وددت أني وجدتها فاشتريتها بهذا الشرط (واشترط) (٤) (لهم) (٥) أنها عتيق إذا مت.
Hazrat Sha'bi (may Allah have mercy on him) was asked about a person who buys a slave-girl on the condition that he will neither sell her, nor give her as a gift, nor give her as dowry. He (may Allah have mercy on him) replied: I wish to keep her; I will buy her with this condition, and I will set the condition for them that when I die, she will be free.
Hadith 23129
٢٣١٢٩ - حدثنا أبو بكر قال: حدثنا ابن أبي زائدة عن أشعث عن الحكم عن إبراهيم أنه قال: كل شرط في بيع يهدمه البيع إلا العتاق، وكل شرط في نكاح يهدمه النكاح إلا الطلاق.
Ibrahim (may Allah have mercy on him) said: Every condition that is stipulated in a sale invalidates it, except for emancipation; and every condition that is stipulated in marriage invalidates the marriage, except for divorce.
Hadith 23130
٢٣١٣٠ - حدثنا أبو بكر قال: حدثنا وكيع عن إسماعيل بن أبي خالد عن الشعبي قال: أتت امرأة فقالت: إن ابنتي اشتريت على أن لا تباع قال: ابنتك على شرطها.
A woman came to Hazrat Sha'bi (may Allah have mercy on him) and said, "My daughter has been bought on the condition that she will not be sold." He (may Allah have mercy on him) replied, "Your daughter is subject to the condition of purchase (i.e., the condition that was stipulated at the time of purchase will apply)."
Hadith 23131
٢٣١٣١ - حدثنا أبو بكر قال: حدثنا وكيع قال: حدثنا جعفر بن برقان عن الزهري عن عبيد اللَّه بن (عبد اللَّه بن) (١) عتبة أن ابن مسعود اشترى من (زوجته) (٢) زينب جارية (واشترطت) (٣) عليه إن باعها فهي أحق بها بالثمن، فسأل ابن مسعود عمر فكره أن يطأها (٤).
Hazrat Ibn Mas'ud (may Allah be pleased with him) bought a slave girl from his daughter. She placed a condition on him that if he sold her, she would have a greater right to her price. Hazrat Ibn Mas'ud (may Allah be pleased with him) asked Hazrat Umar (may Allah be pleased with him) about this. Hazrat Umar (may Allah be pleased with him) disliked having intercourse with her.
Hadith 23132
٢٣١٣٢ - حدثنا أبو بكر قال: حدثنا وكيع عن مسعر عن عمران (بن عمير) (١) أن (٢) عمر قال: (لعبد اللَّه) (٣): لا يقربها (٤).
Hazrat Umar (may Allah be pleased with him) said to Hazrat Abdullah (may Allah be pleased with him): Do not go near it.
