Musannaf Ibn Abi Shaybah

It is narrated from Ibn Sirin that a man bought a cloth which had a defect. Hazrat Uthman (may Allah be pleased with him) ruled that he may return it, even if he had worn it.

It was asked from Hasan (may Allah have mercy on him) that a man bought a cloth and then found a defect in it. He replied: An amount of money equal to the value of the defect will be returned from the price.

Muhammad, may Allah have mercy on him, says that if a person buys a cloth and then finds a defect in it, then if the cloth has changed from its original condition, I prefer that the sale be upheld and the price be reduced according to the extent of the defect.

Two men came to Hazrat Shurayh (may Allah have mercy on him) with a dispute; one had bought a cloth from the other and then cut it, and after cutting it, he found a defect in it. He (Hazrat Shurayh) said: The defect you have caused in it by cutting is more severe than the defect that was in it.

Hazrat Shu’bah narrates that I asked Hazrat Hakam, “A person bought a cloth and cut it, then a defect was found in it. What should be done?” He replied, “He will return the cloth.” I then asked Hazrat Hammad the same question. He replied, “He will return the cloth and also pay compensation for cutting it.” (He will also pay a penalty for the damage caused by cutting the cloth.) Shu’bah, the narrator, says that Haithem informed me that Hazrat Hammad says that he will take compensation for the defect from him.

Hazrat Jablah bin Suhaim narrates that I saw Hazrat Ibn Umar (may Allah be pleased with them) buy a shirt and wear it. The shirt became stained yellow from his beard. He intended to return the shirt, but then abandoned the idea of returning it because of the yellow stain.

Hazrat Usman (may Allah have mercy on him) said that if a person buys a shirt in which there is a defect, then he has the choice (whether to keep it or to return it).
