Musannaf Ibn Abi Shaybah

It is narrated from Hazrat Sha'bi (may Allah have mercy on him) that a man claimed ownership of a mule that was in another person's possession and presented witnesses. Then the one in whose possession it was presented witnesses to the effect that the mule was born with him. Hazrat Shurayh (may Allah have mercy on him) decided the case in favor of the one in whose possession it was.

Hazrat Abu Husain (may Allah have mercy on him) says that I was with Hazrat Abdullah bin Utbah when a dispute over pearls was brought to him. Each of them presented witnesses that these belonged to him. I saw Hazrat Abdullah bin Utbah moving it with his hand and saying, "It belongs to the one in whose possession it is."

It is narrated from Hazrat Hakam that there was a dispute between two groups over a mule. Each group presented witnesses claiming the mule belonged to them. Hazrat Abdullah bin Utbah, may Allah have mercy on him, decided that the one in possession of it is its owner.

Ibrahim says that when both parties present witnesses, the thing will belong to the one who has possession of it.

Ibrahim says that when two witnesses testify that this animal belongs to a certain person and was born with him, and another two witnesses testify that it belongs to another person and was born with him, then the decision will be made in favor of the one in whose possession it is.

Hazrat Hakam states that a man had a piece of cloth. Another man presented witnesses that it was his cloth, and the one who had it also presented witnesses that it was his. So he said that it belongs to the one in whose possession it is. And regarding an animal, one man presented witnesses that it was his animal, and the one who had possession of it also presented witnesses that it was his animal. He said that it belongs to the one in whose possession it is.

It is narrated from Hazrat Tamim bin Tarfa (may Allah be pleased with him) that two men claimed ownership of a camel, and each of them presented witnesses that it belonged to him. The Prophet (peace and blessings be upon him) decided that it belonged to both of them.

It is narrated from Hazrat Ibn Abi Laila that two men, disputing over an animal, came to Hazrat Abu Darda (may Allah be pleased with him), and one of them presented witnesses that it belonged to him. He (may Allah be pleased with him) decided the matter for both of them and said: Neither of you was more in need, like the chain of the Children of Israel.

It is narrated from Hazrat Abu Musa (may Allah be pleased with him) that two men disputed over an animal, and each of them presented witnesses that it belonged to him. The Holy Prophet (peace and blessings be upon him) gave a decision in favor of both of them.

It is narrated in a similar manner from Hazrat Abu Musa (may Allah be pleased with him).

It is narrated from Hazrat Abu Hurairah (may Allah be pleased with him) that two men, disputing over an animal, came to the presence of the Prophet ﷺ. Neither of them had any witnesses. The Prophet ﷺ ordered that both of them should draw lots regarding the oath.
