Ruling on Buying and Selling Children
Hadith 22085
٢٢٠٨٥ - حدثنا أبو بكر قال: حدثنا حفص بن غياث عن حجاج عن عطاء عن ابن عباس قال: لا يجوز عتق الصبي ولا بيعه ولا شراؤه (١).
Hazrat Ibn Abbas (may Allah be pleased with them) says that it is not permissible for a child to buy or sell, nor to set a slave free.
Hadith 22086
٢٢٠٨٦ - حدثنا أبو بكر قال: حدثنا ابن المبارك عن يونس عن الزهري قال: لا يجوز شراء الغلام ولا بيعه إلا بإذن وليه.
Hazrat Zuhri says that a child does not have the right to buy or sell without the permission of a guardian.
Hadith 22087
٢٢٠٨٧ - حدثنا أبو بكر قال: حدثنا ابن إدريس عن مطرف قال: قلت للشعبي: يجوز بيعه وشراؤه؟ قال: إذا جاز بيعه وشراؤه جازت عتاقته.
Hazrat Mutarrif says that I asked Hazrat Sha’bi, “Is it permissible for a child to buy and sell?” He replied, “If you consider his buying and selling permissible, then consider his freeing (of a slave) permissible as well.”
Hadith 22088
٢٢٠٨٨ - حدثنا أبو بكر قال: حدثنا ابن إدريس عن هشام عن الحسن قال: لا يجوز بيع الصبي ولا شراؤه.
Hasan says that it is not permissible to buy or sell on behalf of a child.
