Musannaf Ibn Abi Shaybah

Hazrat Abdullah bin Habib narrates that I asked Hazrat Hakam (may Allah have mercy on him) and Hazrat Mujahid (may Allah have mercy on him) that if a man is married to a woman with whom he has consummated the marriage, then he marries another woman, and the first wife says, "I will give you such and such compensation if you give me one divorce and also give one divorce to that (other) woman," and the man does so, then what is the ruling in this case? Hazrat Hakam (may Allah have mercy on him) says that both will become irrevocably divorced (bainah). Hazrat Mujahid (may Allah have mercy on him) says that the one with whom consummation did not take place will become irrevocably divorced (bainah), and on the other, one divorce will take effect.

20410 - Mujahid said: The one with whom he had not consummated marriage is separated (from him), and a single divorce falls upon the other.

20411 - And Waki‘ said: (And the people) (1) are upon the statement of al-Hakam.
