Hadith 20388
٢٠٣٨٨ - حدثنا أبو بكر قال: نا إسحاق الأزرق عن أبي العلاء عن الحسن في رجل قال لامرأته: إن دخلت دار فلان فأنت طالق فهدمت الدار قال: إذا هدمت الدار فليس (بطلاق) (١).
Hazrat Hasan (may Allah be pleased with him) was asked: If a man says to his wife, "If you enter the house of such-and-such person, you are divorced," and afterwards that house collapses, what is the ruling? He replied: If the house has been demolished, then divorce will not take place. Hazrat Abu Hashim (may Allah have mercy on him) says: If the house belonged to that man, or if a pathway was made and the woman passed through there, then she will be divorced.
Hadith 20389
٢٠٣٨٩ - (قال) (١): وقال (أبو هاشم) (٢): إذا كانت الدار في ملك الرجل فهدمت أو كانت طريقا فدخلته فقد وقع عليها الطلاق.
20389 - (He said) (1): And (Abu Hashim) (2) said: If the house is in the ownership of the man and it is demolished or becomes a road and he enters it, then divorce has taken place upon it.
