Musannaf Ibn Abi Shaybah

Hazrat Hasan (may Allah be pleased with him) says that if a person says to his wife that if he does not marry another woman while she is with him, then she is divorced. In this case, if he marries, divorce will not take place. If either of them dies, they will not inherit from each other.

Hazrat Sha'bi (may Allah have mercy on him) says that if a man swears an oath that if he does not flog his slave with a hundred lashes, his wife will be divorced. In such a case, his wife will remain his wife until the slave dies.

Hazrat Hakam (may Allah have mercy on him) says that if a person says to his wife that if she does not beat his slave, then she is divorced. Then his slave ran away. Both of them (the husband and wife) can have intercourse and will also inherit from each other.

Hazrat Hammad (may Allah have mercy on him) says that if a man swore an oath that if he did not go to Basra, his wife would be divorced, and then he did not go to Basra until his wife passed away, and after her death he went to Basra, then in this case the woman will not receive inheritance and the breaking of the man's oath will now be considered to have occurred.

Hazrat Sha'bi (may Allah have mercy on him) says that in the mentioned situation, if he went to Basra after her death, then he will be the heir of that woman.

Hazrat Saeed bin Musayyib (may Allah have mercy on him) and Hazrat Hasan (may Allah be pleased with him) say that if a man says to his wife, "If I do not marry someone else over you or if I do not divorce you, then you are divorced," in this case, the man cannot go near his wife, and if so, neither of them will be heirs to each other.

Hazrat Hasan (may Allah be pleased with him) says that if a person said to his wife that if I do not go towards Wasit, then his wife will be divorced. In this case, the man will have intercourse with his wife and neither of them will inherit from each other. And Hazrat Ibn Sirin says that he should not have intercourse with her until he does what he has said.
