Musannaf Ibn Abi Shaybah

Hazrat Salih (may Allah have mercy on him) narrates that Hazrat Abdur Rahman bin Auf (may Allah be pleased with him) divorced his wife during his terminal illness, so Hazrat Uthman (may Allah be pleased with him) included her among the heirs after the completion of her waiting period.

Hazrat Ubayy bin Ka'b (may Allah be pleased with him) says that if a person divorces his wife during his death illness, she will be an heir. Even if a year passes after that. However, if the man recovers or the woman gets married, then she will not receive inheritance.

Hazrat Ibn Abi Mulaykah (may Allah have mercy on him) narrates that I asked Hazrat Ibn Zubair (may Allah be pleased with him) if a person, during his terminal illness, gives his wife three divorces, will she have a share in his inheritance? He replied that Hazrat Uthman had given Asbagh's daughter a share in the inheritance, but in my opinion, such a woman will not be an heir.

Hazrat Khalid bin Abdullah (may Allah have mercy on him) asked Hazrat Hasan (may Allah be pleased with him) that if a person, during his terminal illness, gives his wife three divorces, will she have a share in his inheritance? He replied that she will be an heir.

Hazrat Ata (may Allah have mercy on him) says that if he remained ill for a year, then the woman will inherit.
