Musannaf Ibn Abi Shaybah

Hazrat Uthman bin Affan (may Allah be pleased with him) and Hazrat Zaid bin Thabit (may Allah be pleased with him) say regarding Ilaa that when four months have passed, then this is one divorce, and after that the woman has more right over herself.

Hazrat Nu'man bin Bashir (may Allah be pleased with him) took an oath of abstinence (ila) from his wife, so Hazrat Ibn Mas'ud (may Allah be pleased with him) said that when four months have passed, the woman becomes separated (bainah) with one divorce.

Hazrat Abdullah (may Allah be pleased with him) says that when a man performed ila and four months passed, then the woman became separated (bainah) with one divorce.

Hazrat Ibn Umar (may Allah be pleased with both of them) and Hazrat Ibn Abbas (may Allah be pleased with both of them) state that when a woman performed ila’ (oath of abstinence) with a man and did not fulfill it, and four months passed, then the woman received one irrevocable divorce (talaq bainah).

Hazrat Habib (may Allah have mercy on him) says that the Amir of Makkah asked Hazrat Saeed (may Allah have mercy on him) about Ilaa, so he replied that Hazrat Ibn Abbas (may Allah be pleased with them both) used to say that when four months have passed, the woman becomes the owner of her own affair, and Hazrat Ibn Umar (may Allah be pleased with them both) also used to say the same.

Hazrat Ibn Abbas (may Allah be pleased with them both) says that the determination of divorce is the passing of four months.

Hazrat Ali (may Allah be pleased with him) said that when four months have passed, then this is one irrevocable divorce.

Hazrat Qabeesah (may Allah have mercy on him) says that when four months have passed, then this is one irrevocable divorce.

Hazrat Ibn Abbas (may Allah be pleased with them both) and Hazrat Ibn Hanafiyyah (may Allah be pleased with him) say that when four months have passed, then this is one irrevocable divorce.

Ibrahim (may Allah have mercy on him) said that when four months have passed, this is one irrevocable divorce, and that man has more right to take her back.

Hazrat Masruq (may Allah have mercy on him) says that when four months of Ilaa have passed, then this is one irrevocable divorce. When Hazrat Shurayh (may Allah have mercy on him) was informed of this statement of Hazrat Masruq (may Allah have mercy on him), he said that this is correct.

Hasan (may Allah have mercy on him) and Hazrat Ibn Sirin (may Allah have mercy on him) say that when four months have passed, this is one irrevocable divorce.

Hazrat Saeed bin Musayyib (may Allah have mercy on him) and Hazrat Abu Bakr bin Abdur Rahman (may Allah have mercy on him) say that when four months pass in Ila, then this is one irrevocable divorce, and the man has more right to take the woman back.

Hazrat Mak'hool (may Allah have mercy on him) says that when four months have passed, this is one irrevocable divorce, and the man has more right to take the woman back.

Hazrat Alqamah (may Allah have mercy on him) narrates that a man from among the children of Hazrat Anas (may Allah be pleased with him) made an oath of Ilaa against his wife. That woman waited for six months. Once, that man was sitting in a gathering when he remembered the Ilaa. He went to Hazrat Ibn Mas'ud (may Allah be pleased with him) and asked him about it. He replied, "Inform the woman that she has become the owner of her own affair." The man went to her and informed her. The woman said, "I am still your wife," and the man gave her one ratl as mahr.

Hazrat Jarir (may Allah have mercy on him) says that I read in the letter of Hazrat Abu Qalabah (may Allah have mercy on him), which was with Ayub (may Allah have mercy on him), that I asked Hazrat Abu Salamah (may Allah have mercy on him) and Hazrat Salim (may Allah have mercy on him) about Ilaa, so they said that when four months pass, one irrevocable divorce (Talaq Bainah) takes place.

Hazrat Ata (may Allah have mercy on him) says that when four months have passed, this is one irrevocable divorce; during the waiting period, only her husband can send her a marriage proposal, no one else can send it.
