Musannaf Ibn Abi Shaybah

Hazrat Ibn Umar (may Allah be pleased with them both) states that in such a situation, the right of a new divorce will apply.

Hazrat Ibn Abbas (may Allah be pleased with both of them) and Hazrat Ibn Umar (may Allah be pleased with both of them) state that in such a situation, the right of a new divorce will apply.

Ibrahim (may Allah have mercy on him) said that in the case of a new contract, the woman will return with three divorces.

Ibrahim (may Allah have mercy on him) said that the students of Abdullah (may Allah be pleased with him) used to say: If three divorces can grant the right to a new divorce, then why can't one or two divorces grant that right?

Ibrahim (may Allah have mercy on him) said that the students of Hazrat Abdullah (may Allah be pleased with him) used to say: If three divorces can grant the right to a new divorce, then why can’t one or two divorces grant that right?

Ibrahim (may Allah have mercy on him) said that the students of Abdullah (may Allah be pleased with him) used to say this, while Ubaidah used to say that a man will only have the right to the remaining divorces. One or two divorces can grant the right to a new divorce just as three divorces grant the right to a new divorce.

Hazrat Shurayh (may Allah have mercy on him) says that she will return with a new divorce and a new marriage.

Hazrat Maymoon (may Allah have mercy on him) said that she will return with a new divorce.

Hazrat Raja’ (may Allah have mercy on him) says that I asked Hazrat Qabeesah (may Allah have mercy on him): A man divorced his wife and she became irrevocably separated (bainah). She completed her waiting period (‘iddah) and married another man. He had intercourse with her, then either died or divorced her. If she then returns to her first husband, with how many divorces will she return? He replied: With the remaining divorces. I asked: If he divorced her a second time, she became irrevocably separated, then married another man, he had intercourse with her, and then either died or divorced her, and she returned to her first husband, with how many divorces will she return? He replied: With the remaining divorces. I said: He divorced her again, after the waiting period she married another man, he had intercourse with her and then either divorced her or died, and this woman returned to her first husband, with how many divorces will she return? He replied: With three divorces.

Ibrahim (may Allah have mercy on him) said: If he had intercourse, she will return with three divorces, and if he did not have intercourse, she will return with the remaining divorces.
