Musannaf Ibn Abi Shaybah

Ibrahim (may Allah have mercy on him) says that there is no specific waiting period in zihar, but if someone says to his wife, "If I come near you," then the waiting period for zihar can begin. If he says this and leaves her for four months, then the woman will become separated due to ila.

Hazrat Sha'bi (may Allah have mercy on him) says that if a man says to his wife, "If I come near you, then you are to me like the back of my mother," and if he comes near her, then zihar will take place, and if he leaves her for four months, then due to ila, the woman will become separated (bainah) from him.

Hasan (may Allah have mercy on him) said: This is Ilaa.

Hazrat Ata (may Allah have mercy on him) says that if a person said to his wife, "If I come near you, then you are to me like the back of my mother," and then left her for four months, then this is nothing.

Hasan (may Allah have mercy on him) and Ibrahim (may Allah have mercy on him) say that if a man says to his wife, "If I come to you, then you are to me like the back of my mother," and if he comes to her within four months, then it is zihar; and if he does not come, then it is ila, and the woman will become separated (bainah) from him with one divorce.

Hazrat Sha’bah (may Allah have mercy on him) says that I asked Hazrat Hakam (may Allah have mercy on him) and Hazrat Hammad (may Allah have mercy on him) that if a person says to his wife, “If I come near you within a year, then you are to me like the back of my mother,” what is the ruling? They replied that when four months have passed, one irrevocable divorce (talaq bainah) will take place.
