Those Scholars Who Say If a Slave Marries Without the Master's Permission, the Right of Divorce Belongs to the Master
Hadith 19304
١٩٣٠٤ - حدثنا أبو بكر قال: نا ابن فضيل عن (حصين) (١) عن عامر قال: إذا تزوج العبد بغير إذن سيده فالطلاق بيد سيده.
Hazrat Aamir (may Allah have mercy on him) says that if a slave marries without the master's permission, the right of divorce will belong to the master.
Hadith 19305
١٩٣٠٥ - حدثنا أبو بكر قال: نا يحيى بن آدم قال: (حدثنا) (١) إسرائيل عن (منصور) (٢) عن إبراهيم في العبد يتزوج بغير إذن سيده قال: إن شاء السيد أبطل ذلك وإن شاء سكت.
Ibrahim (may Allah have mercy on him) said that if a slave marries without the permission of his master, then the master, if he wishes, may annul the marriage, and if he wishes, may remain silent.
Hadith 19306
١٩٣٠٦ - حدثنا أبو بكر قال: نا وكيع عن إسماعيل بن أبي خالد عن الشعبي قال: إذا تزوج العبد بغير إذن سيده فالطلاق بيد السيد وإذا تزوج بإذنه فالطلاق بيد العبد.
Hazrat Sha'bi (may Allah have mercy on him) says that if a slave marries without the master's permission, then the right of divorce will belong to the master, and if he marries with the master's permission, then the right of divorce will belong to the slave.
Hadith 19307
١٩٣٠٧ - حدثنا أبو بكر قال: نا وكيع قال: (حدثنا) (١) العمري عن نافع عن ابن عمر مثله (٢) (٣).
The same is also narrated from Hazrat Ibn Umar (may Allah be pleased with them both).
