Musannaf Ibn Abi Shaybah

Hazrat Ibn Abbas (may Allah be pleased with both of them) was asked: If a person gives his wife the authority over her own matter, and then the woman says, "You are divorced three times," what is the ruling? He replied: Allah caused her tongue to utter something incorrect; if she had said, "I am divorced three times," then the divorce would have taken place.

Hazrat Mansur (may Allah have mercy on him) says that I asked Ibrahim (may Allah have mercy on him) that if a person gives his wife the matter (of divorce) into her own hands, and then the woman says, "You are divorced three times," what is the ruling? He replied that whether she says, "I have divorced you," or she says, "I have divorced myself," in both cases only one divorce will take place, and the husband will have more right to take her back.

Hazrat Alqamah (may Allah have mercy on him) narrates that I was with Hazrat Abdullah bin Masood (may Allah be pleased with him) when a man came and said, "O Abu Abdur Rahman! There was some dispute between me and my wife. She said to me, 'If you hand over your matter to me, then see what I do.' I said, 'It is in your hand.' Then she gave herself three divorces." Hazrat Abdullah (may Allah be pleased with him) said, "One divorce has taken place, and you have more right to take her back." He says that then I mentioned this to Hazrat Umar (may Allah be pleased with him), and he said, "If you had said anything else, I would have thought that you did not say the correct thing."
