Musannaf Ibn Abi Shaybah

It was written in the book of Hazrat Abdullah bin Amr (may Allah be pleased with him) that when a madman troubles his wife, her guardian can divorce the woman.

Hazrat Ata (may Allah have mercy on him) says that the guardian of a madman can give divorce on his behalf, but he should wait for him to recover.

Hazrat Saeed bin Musayyib (may Allah have mercy on him) says that the divorce of an overpowered-minded and insane person is not valid; his guardian will give divorce on his behalf.

Ayub (may Allah have mercy on him) says that I wrote a letter to Hazrat Abu Qilabah (may Allah have mercy on him) asking: If a madman whose recovery is not expected, can the guardian divorce his wife on his behalf? He replied to me in writing that he cannot divorce her; Allah has tested this woman, she should be patient.

Hazrat Zuhri (may Allah have mercy on him) says that the divorce given by the guardian of an insane person, etc., is not valid.
