ما قالوا في طلاق المعتوه
Ruling on the Divorce of a Mentally Deficient Person
Hadith 18871
١٨٨٧١ - حدثنا أبو بكر قال: نا وكيع عن الأعمش عن إبراهيم عن عابس (بن) (١) ربيعة عن علي قال: كل طلاق جائز، إلا طلاق المعتوه (٢).
Hazrat Ali (may Allah be pleased with him) says that every divorce is valid except the divorce of one who is of unsound mind.
Hadith 18872
١٨٨٧٢ - حدثنا أبو بكر قال: نا ابن إدريس عن الأعمش عن إبراهيم عن عابس ابن ربيعة قال: سمعت عليًا يقوله (١).
It is narrated similarly through another chain.

١٨٨٧٣ - حدثنا أبو بكر قال: نا أبو الأحوص عن (أبي إسحاق) (١) عن إبراهيم ⦗١٣٧⦘ قال: (قال علي) (٢): كل طلاق جائز، إلا طلاق المعتوه (٣).
Hazrat Ali (may Allah be pleased with him) says that every divorce is valid except the divorce of one who is of unsound mind.
Hadith 18874
١٨٨٧٤ - حدثنا أبو بكر قال: (حدثنا) (١) أبو بكر الحنفي عن أسامة عن نافع أن (المجبر) (٢) بن عبد الرحمن طلق امرأته وهو معتوه (فأمر) (٣) ابن عمر أن (تعتد) (٤) فقيل له: إنه معتوه فقال: إني لم أسمع اللَّه استثنى لمعتوه طلاقا ولا غيره (٥).
Hazrat Nafi’ (may Allah have mercy on him) narrates that Mujbir bin Abdur Rahman (may Allah have mercy on him) divorced his wife while she was in a state of diminished intellect, so Hazrat Ibn Umar (may Allah be pleased with them both) ordered his wife to observe the waiting period (‘iddah). It was said to him that she is of diminished intellect. Hazrat Ibn Umar (may Allah be pleased with them both) replied that he had not heard that Allah Almighty had made an exception for the divorce of someone of diminished intellect or anyone else.
Hadith 18875
١٨٨٧٥ - حدثنا أبو بكر قال: حدثنا عبد اللَّه بن إدريس عن إسماعيل عن الشعبي قال: ليس لمعتوه ولا لصبي طلاق.
Hazrat Sha'bi (may Allah have mercy on him) says that the divorce of a person of unsound mind and a child does not take effect.
Hadith 18876
١٨٨٧٦ - حدثنا أبو بكر قال: نا عبد السلام بن حرب عن مغيرة عن إبراهيم قال: إذا طلق المعتوه (١) في (حال) (٢) إفاقته؟ قال: (جاز) (٣).
Ibrahim (may Allah have mercy on him) said that if a person of unsound mind gives divorce while in a state of sanity, his divorce will take effect.
Hadith 18877
١٨٨٧٧ - حدثنا أبو بكر قال: (نا) (١) عبدة بن سليمان عن سعيد عن قتادة عن سعيد بن المسيب قال: طلاقه ليس بشيء.
Hazrat Saeed bin Musayyib (may Allah have mercy on him) says that the divorce of an insane person is nothing.
Hadith 18878
١٨٨٧٨ - حدثنا أبو بكر قال: نا الفضل بن دكين عن إسرائيل عن أبي حصين عن شريح قال: (لا) (١) يجوز (طلاقه) (٢).
Hazrat Shurayh (may Allah have mercy on him) says that the divorce of an insane person is nothing.
Hadith 18879
١٨٨٧٩ - حدثنا أبو بكر قال: نا أبو أسامة عن جويبر عن الضحاك قال: لا يجوز طلاقه.
Hazrat Dahhak (may Allah have mercy on him) says that the divorce of an insane person is nothing.
Hadith 18880
١٨٨٨٠ - حدثنا أبو بكر قال: نا عبد الأعلى عن معمر عن الزهري قال: (١) ليس له طلاق.
Hazrat Zuhri (may Allah have mercy on him) says that the divorce of an insane person is nothing.
Hadith 18881
١٨٨٨١ - حدثنا أبو بكر قال: (نا وكيع) (١) (قال: نا) (٢) سفيان عن منصور (٣) إبراهيم قال: كان يقال: كل الطلاق جائز إلا طلاق المعتوه.
Ibrahim (may Allah have mercy on him) said that the divorce of everyone except the insane is valid.
Hadith 18882
١٨٨٨٢ - حدثنا أبو بكر قال: نا عبد الأعلى عن داود عن الشعبي قال: ليس لمعتوه طلاق.
Hazrat Sha'bi (may Allah have mercy on him) said that the divorce of an insane person is nothing.
