Musannaf Ibn Abi Shaybah

Hazrat Salim, Hazrat Qasim, and Hazrat Umar bin Abdul Aziz (s) considered this divorce to be permissible.

Hazrat Mujahid (may Allah have mercy on him) says that stay away from that woman.

Hazrat Sha'bi (may Allah have mercy on him) and Ibrahim (may Allah have mercy on him) say that when divorce is specified with a certain time, the divorce will take place.

Hazrat Sha'bi, may Allah have mercy on him, was asked: If a man says to his wife, "Any woman I marry while you are still my wife is divorced," what is the ruling? He replied: If he marries any woman while that wife is still with him, she will be divorced.

Hazrat Ata (may Allah have mercy on him) says that if a man, while marrying a woman, sets the condition that if he marries another woman while being with this woman, then she will be divorced, and if a slave girl comes to him, she will be set free, then this condition will be valid.

Hazrat Zuhri (may Allah have mercy on him) says that when a marriage takes place, divorce can also take place.

Hazrat Hammad (may Allah have mercy on him) says that if a man says to his wife, "If I marry any woman while you are present, she will be divorced," then whenever he marries someone, she will be divorced.

Hazrat Qasim (may Allah have mercy on him) and Hazrat Salim (may Allah have mercy on him) were asked: If a man says that the day I marry such-and-such woman, she is divorced, what is the ruling? They replied: It will be exactly as he has said.

Hazrat Ubaidullah bin Umar (may Allah have mercy on him) narrates that I asked Hazrat Qasim (may Allah have mercy on him) about a man who said that the day I marry such-and-such woman, she is divorced. What is the ruling regarding this? He replied that when he marries her, she will be divorced. Hazrat Umar (may Allah be pleased with him) was asked that if a man says about a woman that the day I marry such-and-such woman, on that day she is to me like the back of my mother, what is the ruling regarding this? He replied that he cannot marry her until he gives the expiation.

Ibrahim reports that Hazrat Aswad (may Allah have mercy on him) told a woman that if he married her, she would be divorced. Then, regarding this matter, he asked Hazrat Ibn Mas'ud (may Allah be pleased with him), who said: First inform her about the divorce, then marry her.

Hazrat Umar bin Hamzah (may Allah have mercy on him) says that he asked Hazrat Qasim, Hazrat Abu Bakr bin Abdur Rahman, and Hazrat Abu Bakr bin Amr (may Allah be pleased with them) about the man who said that the day I marry such-and-such woman, she is divorced—so what is the ruling regarding this? All of them replied that he should not marry her.

A man asked Hazrat Shurayh (may Allah have mercy on him) that a man said: "The day I marry such-and-such woman, she is divorced." What is the ruling on this? He replied: When he marries her, she will be divorced.

Hazrat Suwaid bin Najeeh (may Allah have mercy on him) says that I asked Hazrat Sha’bi (may Allah have mercy on him) about a man who said that if he marries a certain woman, she is divorced; what is the ruling on this? He replied that it will be as he has said. I said that Hazrat Ikrimah (may Allah have mercy on him) says that divorce takes place after marriage. He replied that Jurmuz is the freed slave of Ibn Abbas (may Allah be pleased with them both).
