Hadith 17697
١٧٦٩٧ - حدثنا عبد الأعلى عن داود عن عبد اللَّه بن قيس أن غلامًا لأبي موسى وكان صاحب إبله تزوج أمة لبني جعدة وساق إليها خمس ذود فحُدّث أبو موسى فأرسل إليهم: أرسلوا إلي (غلامي) (١) ومالي، فقالوا: أما الغلام فغلامك، وأما المال فقد استحل به فرج (صاحبتنا) (٢)، فاختصموا إلى عثمان بن عفان فقضى لهم عثمان بخمس ما أستحل به فرج صاحبتهم وردّ على أبي موسى (ثلاثة) (٣) (أخماسه) (٤) (٥).
Hazrat Abdullah bin Qais narrates that Hazrat Abu Musa Ash'ari (may Allah be pleased with him) had a slave who was also the caretaker of his camels. He married a slave woman from Banu Jadha and gave her five camels as dowry. When Hazrat Abu Musa (may Allah be pleased with him) found out about this, he sent a message to Banu Jadha saying, "Return my slave and my property to me." They replied, "The slave is yours, but the property has now become the woman's dowry." This case was presented before Hazrat Uthman (may Allah be pleased with him), and he ruled that two-fifths of the property would be the woman's dowry and three-fifths would be given to Abu Musa Ash'ari.
Hadith 17698
١٧٦٩٨ - حدثنا ابن فضيل عن أشعث عن ابن سيرين قال: تزوج عبد لأبي موسى في إمرة عمر على خمس قلائص فرفع ذلك إلى عمر فجعل للمرأة قلوصين ولأبي موسى ثلاث قلاص (أو أعطاها) (١) ثلاث (قلائص) (٢)] (٣) ورد على أبي موسى قلوصين قال: أراه تزوج بغير إذنه (٤).
Hazrat Ibn Sirin narrates that during the caliphate of Hazrat Umar (may Allah be pleased with him), a slave of Hazrat Abu Musa Ash'ari (may Allah be pleased with him) married in exchange for five she-camels. Then this case was presented before Hazrat Umar (may Allah be pleased with him), so he ordered that three she-camels be given to Hazrat Abu Musa (may Allah be pleased with him) or made the woman's dowry three she-camels, and returned two she-camels to Hazrat Abu Musa (may Allah be pleased with him). The narrator says that in my opinion, this slave had married without the permission of Hazrat Abu Musa (may Allah be pleased with him).
Hadith 17699
١٧٦٩٩ - حدثنا وكيع عن سفيان عن سلمة بن تمام عن رجل عن ابن عمر قال: لا صداق لها، هي (أباحت) (١) فرجها (٢).
Hazrat Ibn Umar (may Allah be pleased with them both) says that such a woman will not receive any dowry at all; she has made her private part lawful herself.
Hadith 17700
١٧٧٠٠ - حدثنا [وكيع عن سفيان عن فراس عن عامر قال: (يؤخذ) (١) منها ما (استهلكت) (٢) وما لم تستهلك] (٣).
Hazrat Aamir says that all the dower should be taken back from such a woman, both that which she has spent and that which she has not spent.
Hadith 17701
١٧٧٠١ - حدثنا وكيع عن سفيان عن مغيرة عن إبراهيم قال: يؤخذ منها ما لم تستهلك، فأما ما استهلكت فلا شيء.
Ibrahim says that the wealth should be taken back from such a woman which she has not spent, and for what she has already spent, its return should not be demanded.
Hadith 17702
١٧٧٠٢ - حدثنا وكيع عن شعبة قال: سألت الحكم وحمادًا عن العبد يتزوج المرأة بغير إذن مواليه، قال (١): يفرق بينهما ولا صداق لها، يؤخذ منها ما أخذت.
Hazrat Sha’bah says that I asked Hazrat Hakam and Hazrat Hammad: If a slave marries a woman without his master’s permission, what is the ruling? They replied that separation will be enforced between them, the woman will not receive the dowry, and whatever has been given will be taken back.
Hadith 17703
١٧٧٠٣ - حدثنا غندر عن أشعث عن الحسن في مملوك (١) تزوج بغير إذن سيده [فدخل بها قال: لها ما أخذت.
Hasan says that if a slave marries without his master's permission and consummates the marriage with the woman, then whatever dowry he has given to the woman will belong to the woman.
Hadith 17704
١٧٧٠٤ - حدثنا عبد الأعلى عن معمر عن الزهري في العبد إذا تزوج بغير إذن سيده] (١) فليس بنكاح وليس لها شيء.
Hazrat Zuhri says that if a slave marries without the master's permission, the marriage does not take place and the woman will not receive the dowry either.
Hadith 17705
١٧٧٠٥ - [حدثنا سهل بن يوسف عن عمرو عن الحسن في عبد تزوج بغير إذن مولاه وساق صداقا، قال: إن كان دخل بها فلها الصداق، (وإن) (١) لم يدخل بها أخذ المولى الصداق] (٢).
Hasan says that if a slave marries without his master's permission and also gives dowry to the woman, then if he has consummated the marriage, the woman will receive the full dowry, and if he has not consummated the marriage, the amount of the dowry will go to the master.
