Musannaf Ibn Abi Shaybah

Hazrat Aisha (may Allah be pleased with her) narrates that the Messenger of Allah (peace and blessings be upon him) said that permission should be sought from women before arranging their marriage. I said, "O Messenger of Allah! They will feel shy about this!" The Prophet (peace be upon him) said, "A widow has more right over herself, and permission should be sought from a virgin, and her silence is her consent."

It is narrated from Hazrat Ibn Abbas (may Allah be pleased with them both) that the Messenger of Allah (peace be upon him) said: A widow has more right over herself than her guardian, and a virgin should be asked for permission, and her silence is her consent.

Hazrat Ata says that when a marriage proposal would come for any daughter of the Messenger of Allah (peace be upon him), he would sit near her private chamber and say, "So-and-so has sent a marriage proposal for so-and-so." If she remained silent, he would arrange the marriage, and if she pricked her hand, he would not arrange her marriage. While narrating this, the narrator Hazrat Hafs pricked his index finger into his thigh.

Hazrat Ali (may Allah be pleased with him) said that a man cannot marry off his daughter until he seeks her permission.

Ibrahim says that when a woman is under the guardianship of her father, he will not seek her permission, but if she is under the guardianship of someone else, he will seek her permission before marrying her off.

Hazrat Sha'bi says that a man should seek permission from his virgin and previously married daughter before arranging her marriage.

Hasan used to say that it is permissible for a father to arrange the marriage of his daughter in every case, whether she is a virgin or previously married, and whether she likes it or dislikes it.

Hazrat Tawus says that it is not disliked for a man to marry off his previously married daughter to a place where she dislikes the marriage.

Hazrat Qasim and Hazrat Salim used to say that when the father of a virgin marries her off, then the marriage is established, even if she dislikes it.

Hazrat Ata says that if the father of a virgin girl wishes to marry her to someone, and she desires to marry someone else, then the father should respect his daughter's wish if there is no harm in it. Even if the match preferred by the father offers a higher dowry. And if the girl's father forces her, he can do so.

Hazrat Aamir says that no one except the father can compel a woman to marriage.

When Hazrat Uthman bin Affan (may Allah be pleased with him) wanted to marry off any of his daughters, he would sit near her curtain and say, "So-and-so was mentioning you."

Hazrat Tawus says that permission will be sought from a virgin woman even if she is among her parents.

Hazrat Ibn Buraidah narrates that a young woman came to Hazrat Aisha (may Allah be pleased with her) and said, "My father has married me to his nephew so that he may remove his poverty through him. I dislike this marriage." Hazrat Aisha (may Allah be pleased with her) said, "Wait, when the Prophet (peace and blessings be upon him) comes, he will decide." When the Messenger of Allah (peace and blessings be upon him) arrived, the whole matter was mentioned to him, so he called for her father. The Prophet (peace and blessings be upon him) gave the woman the authority to decide. Upon this, the woman said, "If the authority to decide is mine, then I approve of the marriage my father arranged. I only wanted to know whether women have any rights or not."
