٣٣٦٥٧ - حدثنا أبو داود الطيالسي عن حماد بن الجعد عن قتادة أن امرأة أعتقت مملوكًا لها ثم مات لمن يكون ولاؤه، لعصبتها أو لعصبة (ابنها) (١)، قال: كان الحسن وسعيد بن المسيب (يقولان) (٢): هو لعصبة الغلام.
Qatadah narrates that a woman freed her slave, then she died. Is his wala’ (right of inheritance) for her ‘asaba (male relatives) or for her son? It was said that Hasan and Sa’id bin al-Musayyib used to say that it will be for the ‘asaba of the slave. Qatadah says that Khalas narrated to me that Hazrat Ali (may Allah be pleased with him) ruled that it is for the ‘asaba of the slave, and Salih bin al-Khalil narrated to us that Ibn Abbas (may Allah be pleased with them both) said the same.
