٣٣٣٧٥ - حدثنا ابن فضيل عن بسام عن فضيل (قال) (١): قال إبراهيم في رجل ترك جده، وأخته لأبيه وأمه، وأخاه لأبيه، فللجد في قضاء زيد الخمسان من عشرة: أربعة أسهم، (ولأخته من أبيه وأمه) (٢) النصف خمسة، ولأخيه لأبيه ⦗٣١٠⦘ سهم، (يرد) (١) الأخ من الأب في قضاء زيد على (٢) الأخت من الأب والأم، كان لها ثلاثة أخماس المالط فأعطيت النصف من أجل أن ثلاثة أخماس أخماس النصف، وليس للأخت (الواحدة) (٣) وإن (قاسمها) (٤) أكثر من النصف (٥).
Ibrahim says that if a man leaves behind his grandfather, full sister, and paternal half-brother, then according to the decision of Hazrat Zaid (may Allah be pleased with him), the grandfather receives two-fifths of the wealth, that is, four out of ten shares; the full sister receives half of the wealth, that is, five shares; and the paternal half-brother receives one share. In Hazrat Zaid’s (may Allah be pleased with him) decision, the paternal half-brother returns to the full sister; his right was three-fifths of the wealth, but he was given half the wealth because three-fifths of the wealth is more than half, and the share of one sister is not more than half, even if a brother joins her. And Hazrat Ibn Mas’ud (may Allah be pleased with him) used to give half the wealth to the full sister and half to the grandfather, and in the presence of full brothers and sisters, he would not give anything to paternal half-brothers and sisters. And Hazrat Ali (may Allah be pleased with him) used to give half the wealth to the full sister and divide the remaining half between the brothers and the grandfather, in such a way that the grandfather was considered as one of the brothers, as long as the grandfather’s share was not less than one-sixth; if there was one brother, then the remaining half would be divided between the two; and if there were two, then half the wealth would be divided between them; and if there were three, then the grandfather would get one-sixth of the wealth and the rest would be for the brothers. Hazrat Abu Bakr says that this issue, according to the statement of Hazrat Zaid (may Allah be pleased with him), is derived from ten shares, and according to the statement of Hazrat Abdullah (may Allah be pleased with him), from two shares, and Hazrat Ali (may Allah be pleased with him) used to derive this issue from six shares when there were more brothers.
