Hadith 33172
٣٣١٧٢ - حدثنا ابن مبارك عن معمر عن سماك بن الفضل قال: سمعت وهبًا يحدث عن الحكم بن مسعود قال: شهدت عمر أشرك الإخوة من الأب والأم مع الإخوة من (الأم) (١) في الثلث، فقال له رجل: قد قضيت في هذا عام الأول بغير هذا، قال: وكيف قضيت؟ (قال) (٢): جعلته للإخوة للأم ولم تجعل للإخوة من الأب والأم شيئًا، قال: ذلك على ما قضينا، و (هذا) (٣) على ما (نقضي) (٤) (٥).
Hakam bin Masood narrates that I saw Hazrat Umar (may Allah be pleased with him) giving real brothers an equal share with maternal brothers in one-third of the wealth. A man said to him, "Last year, in a similar case, you gave a different verdict." He asked, "What verdict did I give?" The man said, "You gave the wealth to the maternal brothers and gave nothing to the real brothers." He replied, "That verdict was also correct just as we gave it, and this verdict is also correct just as we are giving it."
