٣٣٠٣٧ - حدثنا ابن فضيل عن بيان عن وبرة قال: اشترى رجل أختًا له كانت سبية في الجاهلية، فاشتراها وابنًا لها لا يدري من أبوه، فشب فأصاب مالًا ثم مات فأتوا عمر فقصوا عليه القصة، فقال: خذوا ميراثه، فاجعلوه في بيت المال، ما أراه ترك ولي نعمة ولا أرى لك فريضة، فبلغ ذلك ابن مسعود فقال: (مه) (١) حتى ألقاه، فلقيه فقال: يا أمير المؤمنين، عصبة وولي نعمة؟ قال: كذا؟ قال: نعم، (فأعطاء) (٢) المال (٣).
Wabrah narrates that a man bought his sister who had been taken captive during the time of ignorance, and he bought her along with her son whose father was unknown. The boy grew up and acquired wealth, then he died. People came to Hazrat Umar (may Allah be pleased with him) and explained the whole matter. He said, "Take his inheritance and deposit it in the treasury (Bayt al-Mal). In my opinion, he has left no heir who would be entitled to his wealth, and in my view, you have no right to the inheritance." This news reached Hazrat Ibn Mas'ud (may Allah be pleased with him), and he said, "Leave it!" and he rejected this opinion. After that, he met Hazrat Umar (may Allah be pleased with him) and said, "O Commander of the Faithful! That man is an 'Asabah (agnate) and is entitled to the deceased's wealth." Hazrat Umar asked, "Is it so?" He replied, "Yes!" So he gave the wealth to that man.
