Hadith 20268
٢٠٢٦٨ - حدثنا أبو بكر قال: نا هشيم عن إسماعيل (بن سالم) (١) عن الشعبي أنه سمعه يقول: إذا دخلت المرأة على زوجها -ومعها حلي ومتاع- فمكثت عند زوجها حتى (تموت) (٢) فهو ميراث، وإن أقام أهلها البينة أنه كان عارية عندها إلا أن يكونوا قد أعلموا ذلك الزوج في حياتها قبل موتها.
Hazrat Sha’bi (may Allah have mercy on him) says that when a woman comes to her husband and she has jewelry and belongings with her, and she stays with her husband, then if her husband passes away, all of this will be considered inheritance. Even if the woman’s family testifies that these things were only with her for use. However, if this matter is clarified during the husband’s lifetime, then it is acceptable.
