ما قالوا في الرجل يحلف بالطلاق ليضربن (غلاما) أو (ليتزوجن) على امرأته فيموت قبل أن يفعلIf a Man Swears to Divorce His Wife If He Does Not Beat His Slave or Marries Another Woman, but Dies Before Doing So, What Is the Ruling?
Hadith 20192
٢٠١٩٢ - حدثنا أبو بكر قال: نا محمد بن يزيد عن أبي العلاء عن قتادة عن سعيد بن المسيب والحسن قالا في الرجل يقول لامرأته: إن لم أتزوج عليها، وإن لم أخرجك فأنت طالق، (قالا) (١): (لا يقربها) (٢)، وإن (ماتا) (٣) قبل ذلك لم يتوارثا.
Hazrat Saeed bin Musayyib (may Allah have mercy on him) and Hazrat Hasan (may Allah be pleased with him) say that if a man says to his wife, "If I do not marry someone else over you or if I do not divorce you, then you are divorced," in this case, the man cannot go near his wife, and if so, neither of them will be heirs to each other.
