ما قالوا في الرجل يحلف بالطلاق ليضربن (غلاما) أو (ليتزوجن) على امرأته فيموت قبل أن يفعلIf a Man Swears to Divorce His Wife If He Does Not Beat His Slave or Marries Another Woman, but Dies Before Doing So, What Is the Ruling?
Hadith 20190
٢٠١٩٠ - حدثنا أبو بكر قال: نا جرير عن [مغيرة عن حماد في رجل قال: إن لم (آت) (١) البصرة فامرأته طالق، قال: فلم يأتها حتى ماتت ثم أتاها بعد، قال: لا ميراث له منها، إنما استبان (حنثه) (٢) الآن.
Hazrat Hammad (may Allah have mercy on him) says that if a man swore an oath that if he did not go to Basra, his wife would be divorced, and then he did not go to Basra until his wife passed away, and after her death he went to Basra, then in this case the woman will not receive inheritance and the breaking of the man's oath will now be considered to have occurred.
